AMENDMENT TO SENATE BILL 2491

2    AMENDMENT NO. ______. Amend Senate Bill 2491 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Architectural, Engineering, and Land
5Surveying Qualifications Based Selection Act is amended by
6changing Section 30 as follows:
 
7    (30 ILCS 535/30)  (from Ch. 127, par. 4151-30)
8    Sec. 30. Evaluation procedure. A State agency shall
9evaluate the firms submitting letters of interest and other
10prequalified firms, taking into account qualifications; and
11the State agency may consider, but shall not be limited to
12considering, ability of professional personnel, past record
13and experience, performance data on file, willingness to meet
14time requirements, location, workload of the firm and any
15other qualifications based factors as the State agency may
16determine in writing are applicable. The State agency may

1conduct discussions with and require public presentations by
2firms deemed to be the most qualified regarding their
3qualifications, approach to the project and ability to furnish
4the required services.
5    A State agency shall establish a committee to select firms
6to provide architectural, engineering, and land surveying
7services. A selection committee may include at least one
8public member nominated by a statewide association of the
9profession affected. The public member may not be employed or
10associated with any firm holding a contract with the State
11agency nor may the public member's firm be considered for a
12contract with that State agency while he or she is serving as a
13public member of the committee.
14    In addition, the Department of Transportation may appoint
15public members to selection committees that represent the
16geographic, ethnic, and cultural diversity of the population
17of the State, including persons nominated by associations
18representing minority and female-owned business associations.
19Public members shall be licensed in or have received a degree
20from an accredited college or university in one of the
21professions affected and shall not be employed by, associated
22with, or have an ownership interest in any firm holding or
23seeking to hold a contract while serving as a public member of
24the committee.
25    The term of any member of a selection committee created by
26the Department of Transportation under the provisions of this

1Section prior to January 1, 2022 shall be terminated on
2December 31, 2021. Beginning on or after January 1, 2022, the
3Department of Transportation shall appoint members to serve on
4selection committees to select firms to provide architectural,
5engineering, and land surveying services. In addition to the
6requirements of this Section, the selection committees shall
7consist of 9 members. Of the 9 members appointed under this
8paragraph, 4 appointees shall be members of the public who are
9professional engineers appointed with the advice and consent
10of the Senate.
11    In no case shall a State agency, prior to selecting a firm
12for negotiation under Section 40, seek formal or informal
13submission of verbal or written estimates of costs or
14proposals in terms of dollars, hours required, percentage of
15construction cost, or any other measure of compensation.

17    Section 99. Effective date. This Act takes effect upon
18becoming law.".
