| 2 | | AMENDMENT NO. ______. Amend Senate Bill 2491 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 5. The Architectural, Engineering, and Land | 5 | | Surveying
Qualifications Based Selection Act is amended by | 6 | | changing Section 30 as follows: | 7 | | (30 ILCS 535/30) (from Ch. 127, par. 4151-30) | 8 | | Sec. 30. Evaluation procedure. A State agency shall | 9 | | evaluate the
firms submitting letters of interest and other | 10 | | prequalified firms,
taking into account qualifications; and | 11 | | the State agency may consider, but
shall not be limited to | 12 | | considering, ability of professional personnel,
past record | 13 | | and experience, performance data on file, willingness to meet
| 14 | | time requirements, location, workload of the firm and any | 15 | | other
qualifications based factors as the State agency may | 16 | | determine in writing
are applicable. The State agency may |

| 1 | | conduct discussions with and require
public presentations by | 2 | | firms deemed to be the most qualified regarding
their | 3 | | qualifications, approach to the project and ability to furnish | 4 | | the
required services. | 5 | | A State agency shall establish a committee to select firms | 6 | | to provide
architectural, engineering, and land surveying | 7 | | services. A selection
committee may include at least one | 8 | | public member nominated by a statewide
association of the | 9 | | profession affected. The public member may not be
employed or | 10 | | associated with any firm holding a contract with the State
| 11 | | agency nor may the public member's firm be considered for a
| 12 | | contract with
that State agency while he or she is serving as a | 13 | | public member of the
committee. | 14 | | In addition, the Department of Transportation may appoint | 15 | | public members to selection committees that represent the | 16 | | geographic, ethnic, and cultural diversity of the population | 17 | | of the State, including persons nominated by associations | 18 | | representing minority and female-owned business associations. | 19 | | Public members shall be licensed in or have received a degree | 20 | | from an accredited college or university in one of the | 21 | | professions affected and shall not be employed by, associated | 22 | | with, or have an ownership interest in any firm holding or | 23 | | seeking to hold a contract while serving as a public member of | 24 | | the committee. | 25 | | The term of any member of a selection committee created by | 26 | | the Department of Transportation under the provisions of this |

| 1 | | Section prior to January 1, 2022 shall be terminated on | 2 | | December 31, 2021. Beginning on or after January 1, 2022, the | 3 | | Department of Transportation shall appoint members to serve on | 4 | | selection committees to select firms to provide architectural, | 5 | | engineering, and land surveying services. In addition to the | 6 | | requirements of this Section, the selection committees shall | 7 | | consist of 9 members. Of the 9 members appointed under this | 8 | | paragraph, 4 appointees shall be members of the public who are | 9 | | professional engineers appointed with the advice and consent | 10 | | of the Senate. | 11 | | In no case shall a State agency, prior to selecting a firm | 12 | | for
negotiation under Section 40, seek formal or informal | 13 | | submission of verbal
or written estimates of costs or | 14 | | proposals in terms of dollars, hours
required, percentage of | 15 | | construction cost, or any other measure of

| 17 | | Section 99. Effective date. This Act takes effect upon | 18 | | becoming law.".
