Amends the Safe Pharmaceutical Disposal Act. Provides that any county or municipality shall (rather than may) authorize the use of its city hall, police department, or any other facility under the county's or municipality's control to display a container suitable for use as a receptacle for used, expired, or unwanted pharmaceuticals or sharps (rather than only pharmaceuticals). Defines "sharp". Effective January 1, 2022.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Safe Pharmaceutical Disposal Act is amended | 5 | | by changing Section 17 as follows: | 6 | | (210 ILCS 150/17) | 7 | | Sec. 17. Pharmaceutical or sharp disposal. | 8 | | (a) In this Section, "sharp" means a device with a sharp | 9 | | point or edge that can puncture or cut skin and has an original | 10 | | common medical purpose. "Sharp" includes needles, syringes, | 11 | | lancets, auto injectors, infusion sets, connection needles, | 12 | | and connection sets. | 13 | | (b) Notwithstanding any
provision of law, any county or | 14 | | municipality shall may
authorize the use of its city hall, | 15 | | police department, or any other facility under the county's or | 16 | | municipality's control to
display a container suitable for use | 17 | | as a receptacle for used,
expired, or unwanted pharmaceuticals | 18 | | or sharps . These used, expired, or
unwanted pharmaceuticals | 19 | | may include unused medication and prescription drugs, as well | 20 | | as controlled substances if collected in accordance with | 21 | | federal law. This
receptacle shall only permit the deposit of | 22 | | items, and the
contents shall be locked and secured. The | 23 | | container shall be
accessible to the public and shall have |

| 1 | | posted clearly legible
signage indicating that expired or | 2 | | unwanted prescription drugs
or sharps may be disposed of in | 3 | | the receptacle. The county or municipality shall provide | 4 | | continuous or regular notice to the public regarding the | 5 | | availability of the receptacle. To the extent allowed under | 6 | | federal law, pharmaceuticals collected under this Section may | 7 | | be disposed of in a drug destruction device, as defined in | 8 | | Section 22.58 of the Environmental Protection Act.
