| 2 | | AMENDMENT NO. ______. Amend House Bill 1571 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 1. This Act may be referred to as the First | 5 | | Responders Child Care Act. | 6 | | Section 5. The Department of Human Services Act is amended | 7 | | by adding Section 1-75 as follows: | 8 | | (20 ILCS 1305/1-75 new) | 9 | | Sec. 1-75. Off-Hours Child Care Grant Program. | 10 | | (a) Legislative intent. The General Assembly finds that: | 11 | | (1) Finding child care is a challenge for | 12 | | firefighters, paramedics, police officers, nurses, and | 13 | | other third shift workers across the State who often work | 14 | | non-typical work hours. This affects home life, school, | 15 | | bedtime routines, job safety, and the mental health of |

| 1 | | some of our most critical front line workers. | 2 | | (2) There is a need for increased options for | 3 | | off-hours child care in the State. A majority of the | 4 | | State's child care facilities do not provide care outside | 5 | | of normal work hours, with just 3,251 day care homes and | 6 | | 435 group home care programs that provide night care. | 7 | | (3) Illinois has a vested interest in ensuring that | 8 | | our first responders and working families can provide | 9 | | their children with appropriate care during off hours to | 10 | | improve the morale of existing first responders and to | 11 | | improve recruitment into the future. | 12 | | (b) As used in this Section, "first responders" means | 13 | | emergency medical services personnel as defined in the | 14 | | Emergency Medical Services (EMS) Systems Act, firefighters, | 15 | | law enforcement officers, and, as determined by the | 16 | | Department, any other workers who, on account of their work | 17 | | schedule, need child care outside of the hours when licensed | 18 | | child care
facilities typically operate. | 19 | | (c) Subject to appropriation, the Department of Human | 20 | | Services shall establish and administer an Off-Hours Child | 21 | | Care Grant Program to provide grants to licensed child care | 22 | | facilities to expand their program of services to include | 23 | | off-hours, night, or sleep time child care for first | 24 | | responders and third shift workers who, on account of their | 25 | | work schedule, need child care outside of the hours when | 26 | | licensed child care
facilities typically operate. Services |

| 1 | | funded under the grant program must address the child care | 2 | | needs of first responders. Grants provided under the program | 3 | | may also be used to cover any capital and operating expenses | 4 | | related to the provision of off-hours, night, or sleep time | 5 | | child care for first responders. Child care facilities seeking | 6 | | funding under the grant
program must apply to the Department | 7 | | in a form and manner
prescribed by the Department. Grants | 8 | | awarded under this Section shall be funded through | 9 | | appropriations from the Off-Hours Child Care Grant Program | 10 | | Fund created under subsection (d). The Department shall | 11 | | implement the program by the date the Child Care Advisory | 12 | | Council submits its final report to the General Assembly as | 13 | | provided under Senate Resolution 862 of the 102nd General | 14 | | Assembly or by December 31, 2022, whichever is earlier. The | 15 | | Department may adopt any
rules necessary to implement the | 16 | | grant program. | 17 | | (d) The Off-Hours Child Care Grant Program Fund is created | 18 | | as a special fund in the State treasury. The Fund shall consist | 19 | | of any moneys appropriated to the Department of Human Services | 20 | | for the Off-Hours Child Care Grant Program. Moneys in the Fund | 21 | | shall be expended for the Off-Hours Child Care Grant Program | 22 | | and for no other purpose. All interest earned on moneys in the | 23 | | Fund shall be deposited into the Fund. | 24 | | Section 10. The State Finance Act is amended by adding | 25 | | Section 5.970 as follows: |
