1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Latex
5Glove Ban Act.
 
6    Section 5. Definitions. In this Act:
7    "Department" means the Department of Public Health.
8    "EMS personnel" has the same meaning as provided in
9Section 3.5 of the Emergency Medical Services (EMS) Systems
10Act.
11    "Food service establishment" means a food service
12establishment as that term is used in the Food Handling
13Regulation Enforcement Act.
14    "Health care facility personnel" means personnel of a
15health care facility, as that term is defined under Section 3
16of the Illinois Health Facilities Planning Act.
 
17    Section 10. Use of latex gloves prohibited.
18    (a) On and after January 1, 2023, a food service
19establishment may not permit employees to use latex gloves in
20the preparation and handling of food. If latex gloves must be
21used in the preparation of food due to a crisis that interrupts
22a food service establishment's ability to source nonlatex

1gloves, a sign shall be prominently placed at the point of
2order or point of purchase clearly notifying the public of the
3temporary change. To encourage compliance with this
4subsection, the Department shall send a notice of warning to a
5food service establishment for its first violation of this
6subsection.
7    (b) Except as provided under Section 15, on and after
8January 1, 2023, the use of latex gloves by EMS personnel is
9prohibited.
10    (c) Except as provided under Section 15, on and after
11January 1, 2024, the use of latex gloves by health care
12facility personnel is prohibited if the patient upon whom the
13latex gloves are to be used is unconscious or otherwise
14physically unable to communicate and whose medical history
15lacks sufficient information to indicate whether or not the
16patient has a latex allergy.
 
17    Section 15. Exception; crisis situation. Notwithstanding
18subsections (b) and (c) of Section 10, if a crisis exists that
19interrupts their ability to reliably source nonlatex gloves,
20EMS personnel and health care facility personnel may use latex
21gloves upon a patient. However, during the crisis, EMS
22personnel and health care facility personnel shall prioritize,
23to the extent possible, using nonlatex gloves for the
24treatment of:
25        (1) any patient with a self-identified allergy to

1    latex; and
2        (2) any patient upon whom the latex gloves are to be
3    used who is unconscious or otherwise physically unable to
4    communicate and whose medical history lacks sufficient
5    information to indicate whether or not the patient has a
6    latex allergy.
