| 2 | | AMENDMENT NO. ______. Amend Senate Bill 2027 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 5. The Environmental Protection Act is amended by | 5 | | adding Section 21.7 as follows: | 6 | | (415 ILCS 5/21.7 new) | 7 | | Sec. 21.7. Legacy landfills. | 8 | | (a) The purpose of this Section is to enact legislative | 9 | | recommendations provided by the Mahomet Aquifer Task Force, | 10 | | established under P.A. 100-403. The Task Force identified | 11 | | capped but unregulated or underregulated landfills that | 12 | | overlie the Mahomet Aquifer as potentially hazardous to | 13 | | valuable groundwater resources. | 14 | | (b) The Agency shall prioritize legacy landfills for | 15 | | inspection using existing information within Agency records, | 16 | | municipalities, counties, solid waste management associations, |

| 1 | | companies, corporations, and individuals. | 2 | | (c) Subject to appropriation, the Agency shall use existing | 3 | | information available from State and federal agencies, such as | 4 | | the Prairie Research Institute, the Department of Natural | 5 | | Resources, the Illinois Emergency Management Agency, the | 6 | | Federal Emergency Management Agency, and the Natural Resources | 7 | | Conservation Service, to identify unpermitted waste disposal | 8 | | sites located within the boundaries of the Mahomet Aquifer that | 9 | | may pose a threat to surface water or groundwater resources. | 10 | | (d) Subject to appropriation, the Prairie Research | 11 | | Institute shall offer training to instruct landfill inspectors | 12 | | in the use of remote sensing technologies, geographic | 13 | | information systems, and current database management | 14 | | technologies for the routine inspection and management of | 15 | | landfills. The training shall include, among other things, | 16 | | instruction in: | 17 | | (1) the preparation of georeferenced image maps and the | 18 | | use of aerial photography and other remote sensing | 19 | | technologies, such as Light Detection and Ranging (LiDAR), | 20 | | to identify land erosion, landslides, barren areas, | 21 | | leachate seeps, vegetation, and other relevant surface and | 22 | | subsurface features of the landfills; and | 23 | | (2) the use of geographic information systems and | 24 | | remote sensing technologies to identify site defects, | 25 | | structures, and monitoring wells, and to otherwise assist | 26 | | in the routine inspection and management of landfills. |

| 1 | | The Prairie Research Institute shall provide the Agency | 2 | | with updates on developments in remote sensing technologies, | 3 | | geographic information systems, and current database | 4 | | management technologies that have the potential to improve the | 5 | | routine inspection and management of landfills. | 6 | | (e) The Agency shall use its own data, along with data from | 7 | | municipalities, counties, solid waste management associations, | 8 | | companies, corporations, and individuals, to archive | 9 | | information about legacy landfills for present and long-term | 10 | | use. The resulting records shall be available for use as | 11 | | confidential information by regulatory agencies, but shall not | 12 | | be subject to the Freedom of Information Act. | 13 | | (f) The Agency shall further assemble location information | 14 | | about industries and companies that generate waste, including | 15 | | from historical processes. The resulting records shall be | 16 | | available for use as confidential information by regulatory | 17 | | agencies but shall not be subject to the Freedom of Information | 18 | | Act. | 19 | | (g) For purposes of this Section, "legacy landfills" means | 20 | | landfills without source controls, groundwater monitoring | 21 | | programs, or effective engineering controls, also known as | 22 | | dumps. | 23 | | Section 10. The Illinois Groundwater Protection Act is | 24 | | amended by adding Section 10 as follows: |

| 1 | | (415 ILCS 55/10 new) | 2 | | Sec. 10. Pekin Metro Landfill pilot projects. | 3 | | (a) Subject to appropriation, the Agency shall design and | 4 | | implement up to 2 pilot studies of legacy landfills that | 5 | | overlie the Mahomet Aquifer using, as appropriate, remote | 6 | | sensing technologies and geographic information systems to | 7 | | identify threats to surface and groundwater resources that are | 8 | | posed by the landfills. One of the pilot projects shall be | 9 | | conducted at the Pekin Metro Landfill in Tazewell County if the | 10 | | Agency determines that application of these technologies would | 11 | | be useful in identifying threats to surface and groundwater | 12 | | resources posed by that landfill. The pilot projects shall: | 13 | | (1) inspect and identify potential and current | 14 | | contamination threats to the water quality of aquifers in | 15 | | the same watershed as the landfill (for the Pekin Metro | 16 | | Landfill, the Mahomet Aquifer); | 17 | | (2) use geographic information systems and remote | 18 | | sensing technology to track defects, structures, | 19 | | appliances, and wells for routine inspection and | 20 | | sustainable management; | 21 | | (3) remedy groundwater monitoring mechanisms necessary | 22 | | to initiate a post-closure care period; and | 23 | | (4) utilize the information and data collected from the | 24 | | project to create best management practices for addressing | 25 | | other legacy landfills throughout the State. | 26 | | (b) As used in this Section: |

| 1 | | "Best management practices" means those physical, | 2 | | structural, and managerial practices and prohibitions of | 3 | | practices that, when used singly or in combination, can | 4 | | prevent pollution to groundwater and surface water. | 5 | | "Legacy landfills" means landfills without source | 6 | | controls, groundwater monitoring programs, or effective | 7 | | engineering controls, also known as dumps. ".
