AMENDMENT TO HOUSE BILL 844

AMENDMENT NO. ______. Amend House Bill 844, AS AMENDED, by replacing everything after the enacting clause with the following:

"Section 5. The Grant Accountability and Transparency Act is amended by adding Section 77 as follows:

(30 ILCS 708/77 new)

Sec. 77. Independent Service Coordination agency exemption.

(a) Notwithstanding the provisions of Section 75 or any other provision of law to the contrary, Independent Service Coordination agencies are exempt from the provisions of this Act with respect to the grant application and notice of opportunity process.

(b) Any award granted under this Act by the Division of Developmental Disabilities of the Department of Human Services to an Independent Service Coordination agency prior to the effective date of this amendatory Act of the 101st General Assembly is void. Nothing in this Section shall be construed to prevent the Division from providing grants to existing Independent Service Coordination agencies.

(c) For the purposes of this Section, "Independent Service Coordination agency" means a non-profit organization or a unit of local government that contracts with the Division of Developmental Disabilities of the Department of Human Services to provide independent service coordination as defined under subsection (b) of Section 10 of the Disabilities Services Act of 2003.

Section 99. Effective date. This Act takes effect upon becoming law.".
