Amends the Illinois Vehicle Code. Provides for the placement of temporary stop signs on State and local highways as a substitute for a missing or damaged permanent stop sign. Requires that every temporary stop sign shall conform to the requirements in the State Manual and Specifications. Requires that every temporary stop sign placed on a highway shall be a minimum of 6 feet in height, and shall be in place for no more 2 weeks, except in cases of emergency.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Vehicle Code is amended by changing | 5 | | Sections 11-303 and 11-304 as follows:
| 6 | | (625 ILCS 5/11-303) (from Ch. 95 1/2, par. 11-303)
| 7 | | Sec. 11-303. The Department to place signs on all State | 8 | | highways.
| 9 | | (a) The Department shall place and maintain such | 10 | | traffic-control
devices, including temporary stop signs placed | 11 | | as a substitute for a missing or damaged permanent stop sign, | 12 | | conforming to its manual and specifications on all highways
| 13 | | under its jurisdiction as it shall deem necessary to indicate | 14 | | and to
carry out the provisions of this Chapter or to regulate, | 15 | | warn or guide traffic.
| 16 | | (a-5) Every temporary stop sign placed under this Section | 17 | | shall be located as near as practicable to the nearest line of | 18 | | the crosswalk on the near side of the intersection or, if there | 19 | | is no crosswalk, then as close as practicable to the nearest | 20 | | line of the intersecting roadway. Temporary stop signs placed | 21 | | on highways under this Section shall be a minimum of 6 feet in | 22 | | height, and shall be in place for no more than 2 weeks, except | 23 | | in cases of emergency when circumstances require longer |

| 1 | | placement. | 2 | | (b) No local authority shall place or maintain any | 3 | | traffic-control
device upon any highway under the jurisdiction | 4 | | of the Department except
by the latter's permission.
| 5 | | (c) The Department shall erect and maintain guide, warning | 6 | | and
direction signs upon highways in cities, towns and villages | 7 | | of which
portions or lanes of such highways are under the | 8 | | control and
jurisdiction of the Department or for which the | 9 | | Department has
maintenance responsibility.
| 10 | | (d) Nothing in this Chapter shall divest the corporate | 11 | | authorities
of park districts of power to prohibit or restrict | 12 | | the use of highways
under their jurisdiction by certain types | 13 | | or weights of motor vehicles
or the power of cities, villages, | 14 | | incorporated towns and park districts
to designate highways for | 15 | | one-way traffic or the power of such municipal
corporations to | 16 | | erect and maintain appropriate signs respecting such
uses.
| 17 | | (e) Nothing in this Section shall prohibit a municipality, | 18 | | township, or
county from erecting signs as required under the | 19 | | Illinois Adopt-A-Highway Act.

| 1 | | devices , including temporary stop signs placed as a substitute | 2 | | for a missing or damaged permanent stop sign, upon highways | 3 | | under their maintenance jurisdiction
as are required to | 4 | | indicate and carry out the provisions of this Chapter,
and | 5 | | local traffic ordinances or to regulate, warn, or guide | 6 | | traffic. All
such traffic control devices shall conform to the | 7 | | State Manual and
Specifications and shall be justified by | 8 | | traffic warrants stated in the
Manual. Every temporary stop | 9 | | sign placed under this Section shall be located as near as | 10 | | practicable to the nearest line of the crosswalk on the near | 11 | | side of the intersection or, if there is no crosswalk, then as | 12 | | close as practicable to the nearest line of the intersecting | 13 | | roadway. Temporary stop signs placed on highways under this | 14 | | Section shall be a minimum of 6 feet in height, and shall be in | 15 | | place for no more than 2 weeks, except in cases of emergency | 16 | | when circumstances require longer placement. Placement of | 17 | | traffic-control devices on township or road district
roads also | 18 | | shall be subject to the written approval of the county engineer
| 19 | | or superintendent of highways.
| 20 | | Local authorities in their
respective maintenance | 21 | | jurisdictions shall have the authority to install signs,
in | 22 | | conformance with the State Manual and specifications, alerting | 23 | | motorists of
the tourist oriented businesses available on roads | 24 | | under
local jurisdiction in rural areas as may be required to | 25 | | guide motorists to the
businesses.
The local authorities and | 26 | | road district
highway commissioners shall also have the |

lease space on these signs to the owners | 2 | | or operators of the businesses.
