1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Sections 11-303 and 11-304 as follows:
 
6    (625 ILCS 5/11-303)  (from Ch. 95 1/2, par. 11-303)
7    Sec. 11-303. The Department to place signs on all State
8highways.
9    (a) The Department shall place and maintain such
10traffic-control devices, conforming to its manual and
11specifications on all highways under its jurisdiction as it
12shall deem necessary to indicate and to carry out the
13provisions of this Chapter or to regulate, warn or guide
14traffic. These traffic control devices shall include temporary
15stop signs placed as a substitute for missing or damaged
16permanent stop signs required by the State Manual. Temporary
17stop signs shall be placed in a manner to provide adequate
18visibility and legibility, and shall be placed within duration
19recommendations in the State Manual, unless circumstances
20require longer placement.
21    (b) No local authority shall place or maintain any
22traffic-control device upon any highway under the jurisdiction
23of the Department except by the latter's permission.

1    (c) The Department shall erect and maintain guide, warning
2and direction signs upon highways in cities, towns and villages
3of which portions or lanes of such highways are under the
4control and jurisdiction of the Department or for which the
5Department has maintenance responsibility.
6    (d) Nothing in this Chapter shall divest the corporate
7authorities of park districts of power to prohibit or restrict
8the use of highways under their jurisdiction by certain types
9or weights of motor vehicles or the power of cities, villages,
10incorporated towns and park districts to designate highways for
11one-way traffic or the power of such municipal corporations to
12erect and maintain appropriate signs respecting such uses.
13    (e) Nothing in this Section shall prohibit a municipality,
14township, or county from erecting signs as required under the
15Illinois Adopt-A-Highway Act.

19oriented businesses signs.
20    Local authorities in their respective maintenance
21jurisdiction shall place and maintain such traffic-control
22devices, including temporary stop signs placed as a substitute
23for missing or damaged permanent stop signs required by the
24State Manual, upon highways under their maintenance
25jurisdiction as are required to indicate and carry out the

1provisions of this Chapter, and local traffic ordinances or to
2regulate, warn, or guide traffic. All such traffic control
3devices shall conform to the State Manual and Specifications
4and shall be justified by traffic warrants stated in the
5Manual. Temporary stop signs shall be placed in a manner to
6provide adequate visibility and legibility, and shall be placed
7within duration recommendations in the State Manual, unless
8circumstances require longer placement. Placement of
9traffic-control devices on township or road district roads also
10shall be subject to the written approval of the county engineer
11or superintendent of highways.
12    Local authorities in their respective maintenance
13jurisdictions shall have the authority to install signs, in
14conformance with the State Manual and specifications, alerting
15motorists of the tourist oriented businesses available on roads
16under local jurisdiction in rural areas as may be required to
17guide motorists to the businesses. The local authorities and
18road district highway commissioners shall also have the
19authority to sell or lease space on these signs to the owners
20or operators of the businesses.
