| 2 | | AMENDMENT NO. ______. Amend House Bill 3307 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 5. The State Comptroller Act is amended by adding | 5 | | Section 27 as follows: | 6 | | (15 ILCS 405/27 new) | 7 | | Sec. 27. Electronic posting of State contracts. | 8 | | Notwithstanding any other provision of law: | 9 | | (a) The State agency or agencies involved shall post all | 10 | | proposed contracts, and all competitive bids thereon, between | 11 | | the State or any State agency and another state or the federal | 12 | | government, or an agency thereof, on the Illinois Transparency | 13 | | and Accountability Portal (ITAP). All such proposed contracts | 14 | | and competitive bids must be posted at least 30 days before | 15 | | they are executed. | 16 | | (b) The State Comptroller shall post all executed contracts |

| 1 | | between the State or any State agency and another state or the | 2 | | federal government, or an agency thereof, on its official | 3 | | website. | 4 | | (c) As used in this Section, "State agency" and "contracts" | 5 | | shall have the meanings given to those terms under Section | 6 | | 405-335 of the Department of Central Management Services Law of | 7 | | the Civil Administrative Code of Illinois. | 8 | | Section 10. The Department of Central Management Services | 9 | | Law of the
Civil Administrative Code of Illinois is amended by | 10 | | changing Section 405-335 as follows: | 11 | | (20 ILCS 405/405-335) | 12 | | Sec. 405-335. Illinois Transparency and Accountability | 13 | | Portal (ITAP).
| 14 | | (a) The Department, within 12 months after the effective | 15 | | date of this amendatory Act of the 96th General Assembly, shall | 16 | | establish and maintain a website, known as the Illinois | 17 | | Transparency and Accountability Portal (ITAP), with a | 18 | | full-time webmaster tasked with compiling and updating the ITAP | 19 | | database with information received from all State agencies as | 20 | | defined in this Section. Subject to appropriation, the | 21 | | full-time webmaster must also compile and update the ITAP | 22 | | database with information received from all counties, | 23 | | townships, library districts, and municipalities. | 24 | | (b) For purposes of this Section: |

| 1 | | "State agency" means the offices of the constitutional | 2 | | officers identified in Article V of the Illinois Constitution, | 3 | | executive agencies, and departments, boards, commissions, and | 4 | | Authorities under the Governor. | 5 | | "Contracts" means payment obligations with vendors on file | 6 | | with the Office of the Comptroller to purchase goods and | 7 | | services exceeding $10,000 in value (or, in the case of | 8 | | professional or artistic services, exceeding $5,000 in value). | 9 | | "Appropriation" means line-item detail of spending | 10 | | approved by the General Assembly and Governor, categorized by | 11 | | object of expenditure. | 12 | | "Individual consultants" means temporary workers eligible | 13 | | to receive State benefits paid on a State payroll. | 14 | | "Recipients" means State agencies receiving | 15 | | appropriations. | 16 | | (c) The ITAP shall provide direct access to each of the | 17 | | following: | 18 | | (1) A database of all current State employees and | 19 | | individual consultants, except sworn law enforcement | 20 | | officers, sorted separately by: | 21 | | (i) Name. | 22 | | (ii) Employing State agency. | 23 | | (iii) Employing State division. | 24 | | (iv) Employment position title. | 25 | | (v) Current pay rate and year-to-date pay. | 26 | | (2) A database of all current State expenditures, |

| 1 | | sorted separately by agency, category, recipient, and | 2 | | Representative District. | 3 | | (3) A database of all development assistance | 4 | | reportable pursuant to the Corporate Accountability for | 5 | | Tax Expenditures Act, sorted separately by tax credit | 6 | | category, taxpayer, and Representative District. | 7 | | (4) A database of all revocations and suspensions of | 8 | | State occupation and use tax certificates of registration | 9 | | and all revocations and suspensions of State professional | 10 | | licenses, sorted separately by name, geographic location, | 11 | | and certificate of registration number or license number, | 12 | | as applicable. Professional license revocations and | 13 | | suspensions shall be posted only if resulting from a | 14 | | failure to pay taxes, license fees, or child support. | 15 | | (5) A database of all current State contracts, sorted | 16 | | separately by contractor name, awarding officer or agency, | 17 | | contract value, and goods or services provided. | 18 | | (6) A database of all employees hired after the | 19 | | effective date of this amendatory Act of 2010, sorted | 20 | | searchably by each of the following at the time of | 21 | | employment: | 22 | | (i) Name. | 23 | | (ii) Employing State agency. | 24 | | (iii) Employing State division. | 25 | | (iv) Employment position title. | 26 | | (v) Current pay rate and year-to-date pay. |

| 1 | | (vi) County of employment location. | 2 | | (vii) Rutan status. | 3 | | (viii) Status of position as subject to collective | 4 | | bargaining, subject to merit compensation, or exempt | 5 | | under Section 4d of the Personnel Code. | 6 | | (ix) Employment status as probationary, trainee, | 7 | | intern, certified, or exempt from certification. | 8 | | (x) Status as a military veteran. | 9 | | (7) A searchable database of all current county, | 10 | | township, library district, and municipal employees sorted | 11 | | separately by: | 12 | | (i) Employing unit of local government. | 13 | | (ii) Employment position title. | 14 | | (iii) Current pay rate and year-to-date pay. | 15 | | (8) A searchable database of all county, township, and | 16 | | municipal employees hired on or after the effective date of | 17 | | this amendatory Act of the 97th General Assembly, sorted | 18 | | separately by each of the following at the time of | 19 | | employment: | 20 | | (i) Employing unit of local government. | 21 | | (ii) Employment position title. | 22 | | (iii) Current pay rate and year-to-date pay. | 23 | | (9) A searchable database of all library district | 24 | | employees hired on or after August 9, 2013 (the effective | 25 | | date of Public Act 98-246), sorted separately by each of | 26 | | the following at the time of employment: |

| 1 | | (i) Employing unit of local government. | 2 | | (ii) Employment position title. | 3 | | (iii) Current pay rate and year-to-date pay. | 4 | | (10) A link to a website maintained by the Department | 5 | | that contains a list of contact information for each State | 6 | | agency, including a telephone number and a link to the | 7 | | Agency's website. Each State agency shall be responsible
| 8 | | for providing and updating the Department with this
| 9 | | information. | 10 | | (d) The ITAP shall include all information required to be | 11 | | published by subsection (c) of this Section that is available | 12 | | to the Department in a format the Department can compile and | 13 | | publish on the ITAP. The Department shall update the ITAP as | 14 | | additional information becomes available in a format that can | 15 | | be compiled and published on the ITAP by the Department. | 16 | | (e) Each State agency, county, township, library district, | 17 | | and municipality shall cooperate with the Department in | 18 | | furnishing the information necessary for the implementation of | 19 | | this Section within a timeframe specified by the Department. | 20 | | (f) Each county, township, library district, or | 21 | | municipality submitting information to be displayed on the | 22 | | Illinois Transparency and Accountability Portal (ITAP) is | 23 | | responsible for the accuracy of the information provided. | 24 | | (g) The Department, within 6 months after January 1, 2014 | 25 | | (the effective date of Public Act 98-283), shall distribute a | 26 | | spreadsheet or otherwise make data entry available to each |

| 1 | | State agency to facilitate the collection of data on the | 2 | | State's annual workforce characteristics, workforce | 3 | | compensation, and employee mobility. The Department shall | 4 | | determine the data to be collected by each State agency. Each | 5 | | State agency shall cooperate with the Department in furnishing | 6 | | the data necessary for the implementation of this subsection | 7 | | within the timeframe specified by the Department. The | 8 | | Department shall publish the data received from each State | 9 | | agency on the ITAP or another open data site annually. | 10 | | (h) The ITAP shall include all information required to be | 11 | | posted under Section 27 of the State Comptroller Act. | 12 | | (Source: P.A. 97-744, eff. 1-1-13; 98-246, eff. 8-9-13; 98-283, | 13 | | eff. 1-1-14; 98-756, eff. 7-16-14; 98-1084, eff. 1-1-15 .)".
