SYNOPSIS AS INTRODUCED:
 
215 ILCS 5/370b.1 new
225 ILCS 130/47 new

    Amends the Illinois Insurance Code. Provides that payment for services rendered by a registered surgical assistant who is neither an employee of an ambulatory surgical treatment center nor an employee of a hospital shall be paid at the appropriate non-physician modifier rate if the payor would have made payment had the same services been provided by a physician. Makes conforming changes in the Registered Surgical Assistant and Registered Surgical Technologist Title Protection Act.

1    AN ACT concerning insurance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Insurance Code is amended by adding
5Section 370b.1 as follows:
 
6    (215 ILCS 5/370b.1 new)
7    Sec. 370b.1. Surgical assistant payments. Payment for
8services rendered by a registered surgical assistant, as
9defined in the Registered Surgical Assistant and Registered
10Surgical Technologist Title Protection Act, who is neither an
11employee of an ambulatory surgical treatment center, as defined
12in the Ambulatory Surgical Treatment Center Act, nor an
13employee of a hospital shall be paid at the appropriate
14non-physician modifier rate if the payor would have made
15payment had the same services been provided by a physician.
 
16    Section 10. The Registered Surgical Assistant and
17Registered Surgical Technologist Title Protection Act is
18amended by adding Section 47 as follows:
