SYNOPSIS AS INTRODUCED:
 
55 ILCS 5/6-1001.5 new

    Amends the Counties Code. Provides that the chairman, county executive, or president of the board of a county shall annually submit an approved executive budget prepared by the budget director to the committee on finance. Provides that the committee on finance shall then prepare a tentative annual appropriation ordinance which shall be made available for public inspection at least 10 days prior to finalizing the ordinance. Provides that the committee on finance shall hold at least one public hearing not less than one week prior to finalizing the ordinance. Further provides that notice of the tentative ordinance must be placed in a newspaper of general circulation in the county. Restricts home rule powers.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by adding Section
56-1001.5 as follows:
 
6    (55 ILCS 5/6-1001.5 new)
7    Sec. 6-1001.5. Executive budget; annual appropriation
8ordinance. Notwithstanding any provision of law to the
9contrary, on and after the effective date of this amendatory
10Act of the 99th General Assembly, the chairman, county
11executive, or president of the board shall submit to the
12committee on finance an executive budget as prepared by the
13budget director of the county and approved by the chairman,
14county executive, or president of the board. The executive
15budget shall provide the basis upon which the annual
16appropriation ordinance is prepared and enacted.
17    After considering the executive budget submitted by the
18chairman, county executive, or president of the board, the
19committee on finance shall prepare an annual appropriation
20ordinance in tentative form, which shall be made conveniently
21available to public inspection for at least 10 days prior to
22final action thereon, by publication in the journal of the
23proceedings of the county board or in such other form as the

1board may prescribe; and not less than one week after the
2publication of the tentative appropriation ordinance and prior
3to final action thereon, the committee on finance shall hold at
4least one public hearing thereon, notice of which shall be
5given by publication in a newspaper having general circulation
6in the county at least one week prior to the time of such
7hearing. It shall be the duty of the committee on finance to
8prepare the tentative appropriation ordinance and make it so
9available to public inspection and also to arrange for and hold
10the public hearing or hearings.
11    A home rule unit may not create a budget in a manner
12inconsistent with this Section. This Section is a limitation
13under subsection (i) of Section 6 of Article VII of the
14Illinois Constitution on the concurrent exercise by home rule
15units of powers and functions exercised by the State.
