SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/18b-108  from Ch. 95 1/2, par. 18b-108

    Amends the Illinois Vehicle Code. Provides that a willful violation of the Illinois Motor Carrier Safety Law that causes a motor vehicle accident that results in great bodily harm, permanent disability, or disfigurement to another person is a Class 3 felony. Provides that a willful violation of the Illinois Motor Carrier Safety Law that causes a motor vehicle accident that results in the death of another person is a Class 2 felony.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Section 18b-108 as follows:
 
6    (625 ILCS 5/18b-108)  (from Ch. 95 1/2, par. 18b-108)
7    Sec. 18b-108. Violations; Criminal penalties.
8    (a) The provisions of Chapter 16 shall be applicable to
9acts committed by a driver of a motor vehicle that violate this
10Chapter or any rule or regulation issued under this Chapter.
11    (b) Except as provided in subsection (d), any Any driver
12who willfully violates any provision of this Chapter or any
13rule or regulation issued under this Chapter is guilty of a
14Class 4 felony. In addition to any other penalties prescribed
15by law, the maximum fine for each offense is $10,000. Such
16violation shall be prosecuted by the State's Attorney or the
17Attorney General.
18    (c) Except as provided in subsection (d), any Any person,
19other than a driver, who willfully violates or causes another
20to violate any provision of this Chapter or any rule or
21regulation issued under this Chapter is guilty of a Class 3
22felony. In addition to any other penalties prescribed by law,
23the maximum fine for each offense is $25,000. Such violation

1shall be prosecuted at the request of the Department by the
2State's Attorney or the Attorney General.
3    (d) A person who willfully violates a provision of this
4Chapter or a rule or regulation adopted under this Chapter when
5the violation results in a motor vehicle accident that causes
6great bodily harm, permanent disability, or disfigurement to
7another person is guilty of a Class 3 felony. A person who
8willfully violates a provision of this Chapter or a rule or
9regulation adopted under this Chapter when the violation
10results in a motor vehicle accident that causes death to
11another person is guilty of a Class 2 felony.
