SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/11-1308 new

    Amends the Illinois Vehicle Code. Prohibits the parking of non-electric vehicles in charging station spaces designated for electric vehicles. Allows any person or local authority owning or operating a parking facility to remove or cause to be removed any non-electric vehicle parked within a charging station space designated for use by an electric vehicle. Imposes a minimum fine of $75 on a person parking a non-electric vehicle in a space designated for electric vehicles. Requires municipalities to display signs indicating the fine imposed for a violation. Defines "electric vehicle", "electric vehicle charging station", and "electric vehicle registration plates".

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by adding
5Section 11-1308 as follows:
 
6    (625 ILCS 5/11-1308 new)
7    Sec. 11-1308. Unauthorized use of parking places reserved
8for electric vehicles.
9    (a) For the purposes of this Section:
10    "Electric vehicle" means a battery-powered electric
11vehicle operated solely by electricity or a plug-in hybrid
12electric vehicle that operates on electricity and gasoline and
13has a battery that can be recharged from an external source.
14    "Electric vehicle charging station" means any facility or
15equipment that is used to charge a battery or other energy
16storage device of an electric vehicle.
17    "Electric vehicle registration plates" means plates issued
18for the vehicle under Section 3-805 of this Code.
19    (b) It shall be prohibited to park a non-electric vehicle
20in an electric vehicle charging station designated for use by
21electric vehicles, including an electric vehicle charging
22station on any private or public offstreet parking facility. A
23person may only park an electric vehicle or a vehicle properly

1displaying electric vehicle registration plates in an electric
2vehicle charging station space designated for use by electric
3vehicles.
4    (c) Any person or local authority owning or operating any
5public or private offstreet parking facility may, after
6notifying the police or sheriff's department, remove or cause
7to be removed to the nearest garage or other place of safety
8any non-electric vehicle parked within an electric vehicle
9charging station space designated for use by electric vehicles.
10    (d) It shall not be a defense to a charge under this
11Section that the sign or notice posted at the electric vehicle
12charging station or the designated parking space does not
13comply with applicable rules, regulations, or local
14ordinances, if a reasonable person would be made aware by the
15sign or notice on or near the parking space that the space is
16reserved for electric vehicles.
17    (e) Any person found guilty of violating the provisions of
18subsection (b) shall be fined $75 in addition to any costs or
19charges connected with the removal or storage of the
20non-electric vehicle; but municipalities by ordinance may
21impose a fine up to $100 and shall display signs indicating the
22fine imposed. If the amount of the fine is subsequently
23changed, the municipality shall change the sign to indicate the
24current amount of the fine.
