SYNOPSIS AS INTRODUCED:
 
210 ILCS 25/7-101  from Ch. 111 1/2, par. 627-101

    Amends the Illinois Clinical Laboratory and Blood Bank Act. Provides that a clinical laboratory shall examine specimens at the request of a licensed physician assistant in accordance with the written supervision agreement required under the provision of the Physician Assistant Practice Act of 1987 concerning prescriptions, written supervision agreements, and prescriptive authority (rather than the written guidelines required under the provisions of the Physician Assistant Practice Act of 1987 concerning (1) the definition of "physician assistant" and (2) prescriptions, written supervision agreements, and prescriptive authority).

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Clinical Laboratory and Blood Bank
5Act is amended by changing Section 7-101 as follows:
 
6    (210 ILCS 25/7-101)  (from Ch. 111 1/2, par. 627-101)
7    Sec. 7-101. Examination of specimens. A clinical
8laboratory shall examine specimens only at the request of (i) a
9licensed physician, (ii) a licensed dentist, (iii) a licensed
10podiatric physician, (iv) a licensed optometrist, (v) a
11licensed physician assistant in accordance with the written
12supervision agreement guidelines required under subdivision
13(3) of Section 4 and under Section 7.5 of the Physician
14Assistant Practice Act of 1987, (v-A) an advanced practice
15nurse in accordance with the written collaborative agreement
16required under Section 65-35 of the Nurse Practice Act, (vi) an
17authorized law enforcement agency or, in the case of blood
18alcohol, at the request of the individual for whom the test is
19to be performed in compliance with Sections 11-501 and 11-501.1
20of the Illinois Vehicle Code, or (vii) a genetic counselor with
21the specific authority from a referral to order a test or tests
22pursuant to subsection (b) of Section 20 of the Genetic
23Counselor Licensing Act. If the request to a laboratory is

1oral, the physician or other authorized person shall submit a
2written request to the laboratory within 48 hours. If the
3laboratory does not receive the written request within that
4period, it shall note that fact in its records. For purposes of
5this Section, a request made by electronic mail or fax
6constitutes a written request.
