AMENDMENT TO SENATE BILL 2802

2    AMENDMENT NO. ______. Amend Senate Bill 2802 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Sections 3-413 and 3-701 as follows:
 
6    (625 ILCS 5/3-413)  (from Ch. 95 1/2, par. 3-413)
7    Sec. 3-413. Display of registration plates, registration
8stickers, and drive-away permits; registration plate covers.
9    (a) Registration plates issued for a motor vehicle other
10than a motorcycle, trailer, semitrailer, truck-tractor,
11apportioned bus, or apportioned truck shall be attached
12thereto, one in the front and one in the rear. The registration
13plate issued for a motorcycle, trailer or semitrailer required
14to be registered hereunder and any apportionment plate issued
15to a bus under the provisions of this Code shall be attached to
16the rear thereof. The registration plate issued for a

1truck-tractor or an apportioned truck required to be registered
2hereunder shall be attached to the front thereof.
3    (b) Every registration plate shall at all times be securely
4fastened in a horizontal position to the vehicle for which it
5is issued so as to prevent the plate from swinging and at a
6height of not less than 5 inches from the ground, measuring
7from the bottom of such plate, in a place and position to be
8clearly visible and shall be maintained in a condition to be
9clearly legible, free from any materials that would obstruct
10the visibility of the plate. A registration plate on a
11motorcycle may be mounted vertically as long as it is otherwise
12clearly visible. Registration stickers issued as evidence of
13renewed annual registration shall be attached to registration
14plates as required by the Secretary of State, and be clearly
15visible at all times.
16    (c) Every drive-away permit issued pursuant to this Code
17shall be firmly attached to the motor vehicle in the manner
18prescribed by the Secretary of State. If a drive-away permit is
19affixed to a motor vehicle in any other manner the permit shall
20be void and of no effect.
21    (d) The Illinois prorate decal issued to a foreign
22registered vehicle part of a fleet prorated or apportioned with
23Illinois, shall be displayed on a registration plate and
24displayed on the front of such vehicle in the same manner as an
25Illinois registration plate.
26    (e) The registration plate issued for a camper body mounted

1on a truck displaying registration plates shall be attached to
2the rear of the camper body.
3    (f) No person shall operate a vehicle, nor permit the
4operation of a vehicle, upon which is displayed an Illinois
5registration plate, plates or registration stickers, except as
6provided for in subsection (b) of Section 3-701 of this Code,
7after the termination of the registration period for which
8issued or after the expiration date set pursuant to Sections
93-414 and 3-414.1 of this Code.
10    (g) A person may not operate any motor vehicle that is
11equipped with registration plate covers. A violation of this
12subsection (g) or a similar provision of a local ordinance is
13an offense against laws and ordinances regulating the movement
14of traffic.
15    (h) A person may not sell or offer for sale a registration
16plate cover. A violation of this subsection (h) is a business
17offense.
18    (i) A person may not advertise for the purpose of promoting
19the sale of registration plate covers. A violation of this
20subsection (i) is a business offense.
21    (j) A person may not modify the original manufacturer's
22mounting location of the rear registration plate on any vehicle
23so as to conceal the registration or to knowingly cause it to
24be obstructed in an effort to hinder a peace officer from
25obtaining the registration for the enforcement of a violation
26of this Code, Section 27.1 of the Toll Highway Act concerning

1toll evasion, or any municipal ordinance. Modifications
2prohibited by this subsection (j) include but are not limited
3to the use of an electronic device. A violation of this
4subsection (j) is a Class A misdemeanor.

7    Sec. 3-701. Operation of vehicles without evidence of
8registration - Operation under mileage plates when odometer
9broken or disconnected.
10    (a) No person shall operate, nor shall an owner knowingly
11permit to be operated, except as provided in subsection (b) of
12this Section, upon any highway unless there shall be attached
13thereto and displayed thereon when and as required by law,
14proper evidence of registration in Illinois, as follows:
15        (1) A vehicle required to be registered in Illinois. A
16    current and valid Illinois registration sticker or
17    stickers and plate or plates, or an Illinois temporary
18    registration permit, or a drive-away or in-transit permit,
19    issued therefor by the Secretary of State; or
20        (2) A vehicle eligible for Reciprocity. A current and
21    valid reciprocal foreign registration plate or plates
22    properly issued to such vehicle or a temporary registration
23    issued therefor, by the reciprocal State, and, in addition,
24    when required by the Secretary, a current and valid
25    Illinois Reciprocity Permit or Prorate Decal issued

1    therefor by the Secretary of State; or except as otherwise
2    expressly provided for in this Chapter.
3    (b) A person may operate or permit operation of a vehicle,
4upon any highway a vehicle that has been properly registered
5but does not display a current and valid Illinois registration
6sticker if he or she has proof, in the form of a printed
7receipt from the Secretary, that he or she registered the
8vehicle before the previous registration's expiration but has
9not received a new registration sticker from the Secretary.
10This printed proof of registration is valid for 30 days from
11the expiration of the previous registration sticker's date.
12    (c) No person shall operate, nor shall any owner knowingly
13permit to be operated, any vehicle of the second division for
14which the owner has made an election to pay the mileage tax in
15lieu of the annual flat weight tax, at any time when the
16odometer of such vehicle is broken or disconnected, or is
17inoperable or not operating.
