1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Sections 3-413 and 3-701 as follows:
 
6    (625 ILCS 5/3-413)  (from Ch. 95 1/2, par. 3-413)
7    Sec. 3-413. Display of registration plates, registration
8stickers, and drive-away permits; registration plate covers.
9    (a) Registration plates issued for a motor vehicle other
10than a motorcycle, trailer, semitrailer, truck-tractor,
11apportioned bus, or apportioned truck shall be attached
12thereto, one in the front and one in the rear. The registration
13plate issued for a motorcycle, trailer or semitrailer required
14to be registered hereunder and any apportionment plate issued
15to a bus under the provisions of this Code shall be attached to
16the rear thereof. The registration plate issued for a
17truck-tractor or an apportioned truck required to be registered
18hereunder shall be attached to the front thereof.
19    (b) Every registration plate shall at all times be securely
20fastened in a horizontal position to the vehicle for which it
21is issued so as to prevent the plate from swinging and at a
22height of not less than 5 inches from the ground, measuring
23from the bottom of such plate, in a place and position to be

1clearly visible and shall be maintained in a condition to be
2clearly legible, free from any materials that would obstruct
3the visibility of the plate. A registration plate on a
4motorcycle may be mounted vertically as long as it is otherwise
5clearly visible. Registration stickers issued as evidence of
6renewed annual registration shall be attached to registration
7plates as required by the Secretary of State, and be clearly
8visible at all times.
9    (c) Every drive-away permit issued pursuant to this Code
10shall be firmly attached to the motor vehicle in the manner
11prescribed by the Secretary of State. If a drive-away permit is
12affixed to a motor vehicle in any other manner the permit shall
13be void and of no effect.
14    (d) The Illinois prorate decal issued to a foreign
15registered vehicle part of a fleet prorated or apportioned with
16Illinois, shall be displayed on a registration plate and
17displayed on the front of such vehicle in the same manner as an
18Illinois registration plate.
19    (e) The registration plate issued for a camper body mounted
20on a truck displaying registration plates shall be attached to
21the rear of the camper body.
22    (f) No person shall operate a vehicle, nor permit the
23operation of a vehicle, upon which is displayed an Illinois
24registration plate, plates or registration stickers, except as
25provided for in subsection (b) of Section 3-701 of this Code,
26after the termination of the registration period for which

1issued or after the expiration date set pursuant to Sections
23-414 and 3-414.1 of this Code.
3    (g) A person may not operate any motor vehicle that is
4equipped with registration plate covers. A violation of this
5subsection (g) or a similar provision of a local ordinance is
6an offense against laws and ordinances regulating the movement
7of traffic.
8    (h) A person may not sell or offer for sale a registration
9plate cover. A violation of this subsection (h) is a business
10offense.
11    (i) A person may not advertise for the purpose of promoting
12the sale of registration plate covers. A violation of this
13subsection (i) is a business offense.
14    (j) A person may not modify the original manufacturer's
15mounting location of the rear registration plate on any vehicle
16so as to conceal the registration or to knowingly cause it to
17be obstructed in an effort to hinder a peace officer from
18obtaining the registration for the enforcement of a violation
19of this Code, Section 27.1 of the Toll Highway Act concerning
20toll evasion, or any municipal ordinance. Modifications
21prohibited by this subsection (j) include but are not limited
22to the use of an electronic device. A violation of this
23subsection (j) is a Class A misdemeanor.

1    Sec. 3-701. Operation of vehicles without evidence of
2registration - Operation under mileage plates when odometer
3broken or disconnected.
4    (a) No person shall operate, nor shall an owner knowingly
5permit to be operated, except as provided in subsection (b) of
6this Section, upon any highway unless there shall be attached
7thereto and displayed thereon when and as required by law,
8proper evidence of registration in Illinois, as follows:
9        (1) A vehicle required to be registered in Illinois. A
10    current and valid Illinois registration sticker or
11    stickers and plate or plates, or an Illinois temporary
12    registration permit, or a drive-away or in-transit permit,
13    issued therefor by the Secretary of State; or
14        (2) A vehicle eligible for Reciprocity. A current and
15    valid reciprocal foreign registration plate or plates
16    properly issued to such vehicle or a temporary registration
17    issued therefor, by the reciprocal State, and, in addition,
18    when required by the Secretary, a current and valid
19    Illinois Reciprocity Permit or Prorate Decal issued
20    therefor by the Secretary of State; or except as otherwise
21    expressly provided for in this Chapter.
22    (b) A person may operate or permit operation of a vehicle
23upon any highway a vehicle that has been properly registered
24but does not display a current and valid Illinois registration
25sticker if he or she has proof, in the form of a printed
26receipt from the Secretary, that he or she registered the

1vehicle before the previous registration's expiration but has
2not received a new registration sticker from the Secretary.
3This printed proof of registration is valid for 30 days from
4the expiration of the previous registration sticker's date.
5    (c) No person shall operate, nor shall any owner knowingly
6permit to be operated, any vehicle of the second division for
7which the owner has made an election to pay the mileage tax in
8lieu of the annual flat weight tax, at any time when the
9odometer of such vehicle is broken or disconnected, or is
10inoperable or not operating.
