AMENDMENT TO HOUSE BILL 5756

AMENDMENT NO. ______. Amend House Bill 5756 on page 1, line 10, by replacing "service" with "electric or gas service"; and

on page 1, by replacing lines 12 through 15 with the following:

"including entering into a repayment agreement with the utility."; and

on page 2, by inserting immediately below line 26 the following:

"(e) This Section does not apply under the following circumstances:

(1) when utility service has been disconnected at a location other than the meter, except that this Section applies to disconnections using automated metering infrastructure;

(2) when service has been disconnected due to tampering;

(3) when the customer or an adult authorized by the customer does not grant a utility representative access to the meter or other household area required for reconnection at the time of any appointment mutually agreed upon by the utility and the customer;

(4) when an appliance in the customer's premises that require reconnection by a utility representative is not in working order such that reconnection would pose a threat to health or safety; or

(5) when unanticipated circumstances due to extraordinary weather events or conditions prevent compliance with this Section.

(f) If a utility subject to this Section incurs incremental costs associated with compliance with this Section, other than the credits that are not to be recovered in rates, those incremental costs that are just and reasonable shall be recoverable to the extent provided for in Article IX of this Act.".
