AMENDMENT TO HOUSE BILL 4486

AMENDMENT NO. ______. Amend House Bill 4486 by replacing everything after the enacting clause with the following:

"Section 5. The Illinois Grant Funds Recovery Act is amended by adding Section 11.5 as follows:

(30 ILCS 705/11.5 new)

Sec. 11.5. Contract performance metrics.

(a) Consistent with the objectives of budgeting for outcomes, as soon as practicable after the effective date of this amendatory Act of the 98th General Assembly, each grantor agency, in coordination with the Governor's Office of Management and Budget, shall undertake a review of its contracts and grants to assess which contracts and grants, and categories thereof, are appropriate candidates for the implementation of a performance-based contract evaluation model.

(b) Each grantor agency shall refine current performance metrics and develop new metrics for programs, including contracts and grants that fall within the categories determined to be appropriate by the Governor's Office of Management and Budget and the grantor agency under subsection (a) of this Section. Performance metrics may be based on required program components and a methodology that incorporates the reasonable costs of the required program components.

(c) Beginning in State Fiscal Year 2016, each grantor agency shall ensure that service contracts and agreements, as deemed appropriate under subsection (a) of this Section, include performance reporting requirements.

(d) Each grantor agency shall enhance its processes to monitor and address noncompliance with reporting requirements and with program performance standards. Where applicable, the process may include a corrective action plan. The monitoring process shall include a plan for tracking and documenting performance-based contracting decisions.

(e) Notwithstanding any other provision of this Act, the provisions of this Section apply to all contracts and grants subject to this Act.

(f) Nothing in this Section is applicable to grants authorized under the General Obligation Bond Act or the Build Illinois Bond Act.

Section 99. Effective date. This Act takes effect July 1, 2015.".
