AMENDMENT TO HOUSE BILL 4056

2    AMENDMENT NO. ______. Amend House Bill 4056 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Animal Welfare Act is amended by adding
5Section 3.05 as follows:
 
6    (225 ILCS 605/3.05 new)
7    Sec. 3.05. Restrictions on the sale of dogs and cats. No
8pet shop operator or dog dealer shall purchase a dog or cat for
9resale or sell or offer for sale any dog or cat purchased from:
10        (1) any breeder that:
11            (A) is not in possession of a current Class A or
12        Class B animal dealer license issued by the United
13        States Department of Agriculture and any applicable
14        State agency;
15            (B) was found to have committed a direct violation
16        of pet dealer-related regulations of the United States

1        Department of Agriculture during the 2-year period
2        prior to the purchase;
3            (C) received "no access" violations on the 2 most
4        recent inspection reports issued by the United States
5        Department of Agriculture; or
6            (D) was found to have committed 3 or more indirect
7        violations of pet dealer-related regulations of the
8        United States Department of Agriculture during the
9        2-year period prior to the purchase, provided the
10        violations pertained to the health or welfare of an
11        animal and were not administrative in nature; or
12        (2) any other person, firm, or corporation that:
13            (A) is not in possession of a current Class A or
14        Class B animal dealer license issued by the United
15        States Department of Agriculture and any applicable
16        State agency;
17            (B) was found to have committed a direct violation
18        of pet dealer-related regulations of the United States
19        Department of Agriculture during the 2-year period
20        prior to the purchase;
21            (C) received "no access" violations on the 2 most
22        recent inspection reports issued by the United States
23        Department of Agriculture;
24            (D) was found to have committed 3 or more indirect
25        violations of pet dealer-related regulations of the
26        United States Department of Agriculture during the

1        2-year period prior to the purchase, provided the
2        violations pertained to the health or welfare of an
3        animal and were not administrative in nature; or
4            (E) directly or indirectly, has obtained the dog or
5        cat from a breeder described in subdivision (1) of this
6        subsection.".
