AMENDMENT TO SENATE BILL 2551

AMENDMENT NO. ______. Amend Senate Bill 2551 by replacing everything after the enacting clause with the following:

"Section 5. The Prevailing Wage Act is amended by adding Section 2.5 as follows:

(820 ILCS 130/2.5 new)

Sec. 2.5. Applicability of Act.

(a) Beginning July 1, 2013, a person engaging or proposing to engage in the construction of a fixed work may submit to the Department a request for a determination whether the construction is subject to the requirements of this Act. The request must disclose such information about the construction or proposed construction that the Department may require by rule.

(b) The Department shall issue its determination no later than 90 days after receiving all information necessary to render a determination. The Department's decision must state whether the construction or proposed construction is subject to this Act. A determination by the Department that the construction or proposed construction is not subject to this Act is binding upon the Department, and the Department may not at a later date change the determination.

(c) The Department shall create a record of all requests for a determination under this Section and make the record available to the public on the Department's website. The record shall disclose the relevant facts and the final determination, but must redact all information that may identify the party making the request.

(d) The Department may adopt rules necessary for the implementation of this Section.".
