SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/11-1-12 new

    Amends the Illinois Municipal Code. Provides that the corporate authorities of any municipality may establish a database and require businesses located within the municipality to register with the municipality and be listed on the database. Provides that no registration fees shall be charged, and the database shall be a public record subject to The Freedom of Information Act. Further provides that a municipality may charge any business that fails to register a penalty of up to $200. Limits the concurrent exercise of home rule powers. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by adding
5Section 11-1-12 as follows:
 
6    (65 ILCS 5/11-1-12 new)
7    Sec. 11-1-12. Registered businesses. The corporate
8authorities of any municipality may establish a database and
9require businesses located within the municipality to register
10with the municipality and be listed on the database. If a
11database is established, then the municipality shall not charge
12a registration fee for inclusion in the database. The corporate
13authorities of a municipality may charge a maximum penalty of
14$200 for failure to register with the municipality. The
15database shall be a public record subject to The Freedom of
16Information Act. This Section does not limit a home rule
17municipality's ability or grant a municipality the ability to
18collect licensing fees from businesses. This Section is a
19limitation under subsection (i) of Section 6 of Article VII of
20the Illinois Constitution on the concurrent exercise by home
21rule units of powers and functions exercised by the State.
 
22    Section 99. Effective date. This Act takes effect upon
