SYNOPSIS AS INTRODUCED:

40 ILCS 5/1-163 new

Amends the Illinois Pension Code. Adds a provision applicable to new hires that provides that an individual shall not be paid any of the benefits provided under the Code if he or she is convicted of a felony relating to, arising out of, or in connection with his or her service as a member or participant. Effective immediately.

AN ACT concerning public employee benefits.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Pension Code is amended by adding Section 1-163 as follows:

(40 ILCS 5/1-163 new)

Sec. 1-163. Criminal conviction provision applicable to new hires. Notwithstanding any other provision of this Code, an individual who, on or after the effective date of this Section, first becomes a member or a participant under any retirement system or pension fund established under this Code shall not be paid any of the benefits provided under this Code if he or she is convicted of a felony relating to, arising out of, or in connection with his or her service as a member or participant.

This Section shall not operate to impair any contract or vested right acquired before the effective date of this Code under any law or laws continued in this Code, and it shall not preclude the right to a refund.

Section 99. Effective date. This Act takes effect upon becoming law.
