SYNOPSIS AS INTRODUCED:

    Amends the School Code. Subject to appropriation, authorizes the State Board of Education to provide annual funding to public school districts and State-recognized, non-public schools serving students in grades kindergarten through 12 for the purchase of secular textbooks. Subject to appropriation, provides that each public school district and State-recognized, non-public school shall receive a per pupil grant for the purchase of secular textbooks. Repeals Sections concerning the State Board's loan of secular textbooks; the adoption of books by school boards; the purchase of textbooks from families moving out of a school district; the printing, publishing, distributing and selling of textbooks by a district; the manner and methods of textbook distribution; and rules for the care and preservation of textbooks. Effective July 1, 2011.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Section
52-3.153 as follows:
 
6    (105 ILCS 5/2-3.153 new)
7    Sec. 2-3.153. Textbook block grant program.
8    (a) As used in this Section, "textbook" means any book or
9book substitute that a pupil uses as a text or text substitute,
10including electronic textbooks. "Textbook" includes books,
11reusable workbooks, manuals, whether bound or in loose-leaf
12form, instructional computer software, and electronic
13textbooks and the technological equipment necessary to gain
14access to and use electronic textbooks intended as a principal
15source of study material for a given class or group of
16students. "Textbook" also includes science curriculum
17materials in a kit format that includes pre-packaged consumable
18materials if (i) it is shown that the materials serve as a
19textbook substitute, (ii) the materials are for use by the
20pupils as a principal learning source, (iii) each component of
21the materials is integrally necessary to teach the requirements
22of the intended course, (iv) the kit includes teacher guidance
23materials, and (v) the purchase of individual consumable

1materials is not allowed.
2    (b) Beginning July 1, 2011, subject to annual appropriation
3by the General Assembly, the State Board of Education is
4authorized to provide annual funding to public school districts
5and State-recognized, non-public schools serving students in
6grades kindergarten through 12 for the purchase of secular
7textbooks. Each public school district and State-recognized,
8non-public school shall, subject to appropriations for that
9purpose, receive a per pupil grant for the purchase of secular
10textbooks. The per pupil grant amount must be calculated by the
11State Board of Education utilizing the most current student
12enrollment data available divided by the total appropriation
13made for these purposes.
14    (c) The State Board of Education may adopt rules as
15necessary for the implementation of this Section.

23Sections 18-17, 28-6, 28-10, 28-12, 28-16, and 28-17.
 
24    Section 99. Effective date. This Act takes effect July 1,
252011.
