SYNOPSIS AS INTRODUCED:

105 ILCS 5/13B-20.25

    Amends the Alternative Learning Opportunities Law of the School Code. Provides that under no circumstances may an eligible student be denied participation in an alternative learning opportunities program based solely on the fact that he or she has been suspended or expelled from school. Effective July 1, 2011.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Sections
513B-15.10 and 13B-20.25 as follows:
 
6    (105 ILCS 5/13B-15.10)
7    Sec. 13B-15.10. Student at risk of academic failure.
8"Student at risk of academic failure" means a student at risk
9of not meeting the Illinois Learning Standards or not
10graduating from elementary or high school and who demonstrates
11a need for educational support or social services beyond that
12provided by the regular school program. Such students are
13eligible for services up to the age of 21. Under no
14circumstances may a student at risk of academic failure who is
15otherwise eligible be denied participation in an alternative
16learning opportunities program based solely on the fact that he
17or she has been suspended or expelled from school.

20    Sec. 13B-20.25. Eligible students. Students in grades 4
21through 12 who meet enrollment criteria established by the
22school district and who meet the definition of "student at risk

1of academic failure" are eligible to participate in an
2alternative learning opportunities program funded under this
3Article. All rights granted under this Article to a student's
4parent or guardian become exclusively those of the student upon
5the student's 18th birthday. Under no circumstances may an
6eligible student be denied participation in an alternative
7learning opportunities program based solely on the fact that he
8or she has been suspended or expelled from school.

10    Section 99. Effective date. This Act takes effect July 1,
112011.
