AMENDMENT TO HOUSE BILL 1981

2    AMENDMENT NO. ______. Amend House Bill 1981 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Property Tax Code is amended by adding
5Sections 3-70 and 19-85 as follows:
 
6    (35 ILCS 200/3-70 new)
7    Sec. 3-70. Cessation of Township Assessor. If the office of
8Township Assessor in a coterminous township ceases as provided
9in Section 25-30 of the Township Code, then the coterminous
10municipality shall assume the duties of the Township Assessor
11under this Code.

13    Sec. 19-85. Cessation of Township Collector. If the office
14of Township Collector in a coterminous township ceases as
15provided in Section 25-30 of the Township Code, then the

1coterminous municipality shall assume the duties of Township
2Collector under this Code.
 
3    Section 10. The Township Code is amended by changing
4Section 50-20 and by adding Section 25-30 as follows:
 
5    (60 ILCS 1/25-30 new)
6    Sec. 25-30. Discontinuance of a coterminous township.
7    (a) Notwithstanding any provision of Section 25-10 to the
8contrary, the board of trustees of a coterminous township may,
9by ordinance, submit a proposition to discontinue township
10organization to the electors of the township at a general
11election or consolidated election in accordance with general
12election law. The proposition must be approved by the corporate
13authorities of the coterminous municipality prior to placement
14on a ballot.
15    The proposition shall be in substantially the following
16form:
17        Shall the township organization be continued in (name
18    of township)?
19    The votes shall be recorded as "Yes" or "No".
20    If it appears by the returns of the election that a
21three-fifths majority of the votes of the township cast on the
22question of the continuance of township organization at the
23election are against the proposed option for continuance, then
24township organization shall cease in the township on January 1

1of the calendar year immediately following the calendar year
2that the proposition was approved by the electors. Upon
3discontinuance of township organization, all powers, duties,
4assets, property, liabilities, obligations, and
5responsibilities of the township shall be assumed by the
6coterminous municipality.
7    (b) If it appears by the returns of the election that a
8three-fifths majority of the votes of the township cast on the
9question of the continuance of township organization are
10against continuance, then all elected township offices shall
11cease in the township at the next January 1 after the
12proposition was approved. If township organization ceases,
13then the coterminous municipality shall assume the duties of
14all elected township offices.
15    (c) The coterminous municipality shall not assume taxing
16authority of the township abolished under this Section. In the
17event that a coterminous township is discontinued under this
18Section, all township revenues as of the next January 1 after
19the proposition was approved shall be transferred to the
20coterminous municipality.
21    (d) Upon discontinuance of township organization, the
22records of the township shall be deposited in the city or
23village clerk's office, as applicable. The coterminous
24municipality may close up all unfinished business of the
25township and sell and dispose of any of the property belonging
26to the township, as fully as might have been done by the

1township itself, for benefit of the inhabitants of the
2municipality.
3    (e) Nothing in this Section shall prevent the coterminous
4municipality from entering into an intergovernmental agreement
5or contract to provide for general assistance or property
6assessment duties for services under its jurisdiction.
 
7    (60 ILCS 1/50-20)
8    Sec. 50-20. Counties with no township collector. No
9collector in counties under 100,000.
10    (a) No collector in counties under 100,000. In counties
11under township organization, having a population of less than
12100,000, there shall be no township collector elected. The
13county collector shall be ex-officio township collector, and
14all the duties of the township collector shall devolve upon and
15be performed by the county collector.
16    (b) No collector in counties over 2,000,000. In counties
17having a population of more than 2,000,000 inhabitants there
18shall be no township collector elected on and after the
19effective date of this amendatory Act of the 97th General
20Assembly. Upon the completion of the terms of office of
21township collectors holding office on the effective date of
22this amendatory Act of the 97th General Assembly, the township
23assessor shall be the ex-officio township collector, and all
24the duties of the township collector shall devolve upon and be
25performed by the township assessor.

2    Section 15. The Public Health District Act is amended by
3adding Section 25 as follows:
 
4    (70 ILCS 905/25 new)
5    Sec. 25. Cessation of Township Assessor. If the office of
6Township Assessor in a coterminous township ceases as provided
7in Section 25-30 of the Township Code, then the city council or
8village board members of the coterminous municipality shall be
9the board of health for the public health district under this
10Act.
 
11    Section 20. The Illinois Public Aid Code is amended by
12adding Section 12-3.1 as follows:
 
13    (305 ILCS 5/12-3.1 new)
14    Sec. 12-3.1. Discontinuance of a coterminous township.
15Upon discontinuance of a coterminous township as provided in
16Section 25-30 of the Township Code, the coterminous
17municipality shall provide funds for and administer the public
18aid program provided for under Article VI of this Code.
 
19    Section 25. The Illinois Highway Code is amended by adding
20Section 5-210 as follows:

1    (605 ILCS 5/5-210 new)
2    Sec. 5-210. Cessation of Township Highway Commissioner. If
3the office of Highway Commissioner ceases in a coterminous
4township as provided in Section 25-30 of the Township Code,
5then the coterminous municipality shall assume the duties of
6Highway Commissioner under this Code.
 
7    Section 99. Effective date. This Act takes effect upon
8becoming law.".
