SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/11-6-7 new

    Amends the Illinois Municipal Code. Provides that whenever an unincorporated parcel of land that is within the boundaries of a fire protection district is annexed into the corporate limits of a municipality with a municipal fire department, the municipal fire department and the fire protection district may negotiate an intergovernmental agreement to allow the fire protection district to have jurisdiction over the annexed parcel. If no agreement is adopted, then the automatic transfer of jurisdiction from the fire protection district to the municipality shall occur upon annexation. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by adding
5Section 11-6-7 as follows:
 
6    (65 ILCS 5/11-6-7 new)
7    Sec. 11-6-7. Annexation; intergovernmental agreement.
8Whenever an unincorporated parcel of land that is within the
9boundaries of a fire protection district is annexed into the
10corporate limits of a municipality with a municipal fire
11department, the municipal fire department and the fire
12protection district may negotiate an intergovernmental
13agreement to allow the fire protection district to have
14jurisdiction over the annexed parcel in such instances when it
15is not economically feasible for the municipal fire department
16to have jurisdiction over the annexed property or when the
17municipal fire department has determined that a hardship exists
18that would compromise the safety and well-being of the annexed
19property. If no agreement is adopted by both the municipality
20and fire protection district, then the automatic transfer of
21jurisdiction from the fire protection district to the
22municipality shall occur upon annexation.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
