SYNOPSIS AS INTRODUCED:

15 ILCS 405/10.01

from Ch. 15, par. 210.01

Amends the State Comptroller Act. Provides that the Comptroller shall not draw a warrant on the treasury for an amount that is less than $5, unless the person owed the funds makes a request, in writing, to the Office of the State Comptroller that the Comptroller draw the warrant. Provides that the Comptroller shall adopt rules to implement the requirement. Effective immediately.

AN ACT concerning State government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The State Comptroller Act is amended by changing Section 10.01 as follows:

Sec. 10.01.

(a) On ascertaining the amount due any person from the treasury or from other funds held by the treasurer, the comptroller shall draw his or her warrant on the treasury or on such other funds as may be appropriate for the sum due. Warrants shall be directed to the State Treasurer as an order to him or her to pay the sum due.

(b) Notwithstanding any provision of law to the contrary, the Comptroller shall not draw a warrant on the treasury for an amount that is less than $5, unless the person owed the money makes a request, in writing, to the Office of the State Comptroller that the Comptroller draw the warrant. Until the amount of the warrant equals $5, the Comptroller shall deposit the money into an interest-bearing account. The Comptroller shall adopt rules to implement the requirements of this subsection (b).

Section 99. Effective date. This Act takes effect upon becoming law.
