AMENDMENT TO HOUSE BILL 1070

2    AMENDMENT NO. ______. Amend House Bill 1070, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Illinois Vehicle Code is amended by
6changing Section 3-600 and 3-633 and adding Section 3-600.1 as
7follows:
 
8    (625 ILCS 5/3-600)  (from Ch. 95 1/2, par. 3-600)
9    Sec. 3-600. Requirements for issuance of special plates.
10    (a) The Secretary of State shall issue only special plates
11that have been authorized by the General Assembly. The
12Secretary of State shall not issue a series of special plates
13unless applications, as prescribed by the Secretary, have been
14received for 10,000 plates of that series; except that the
15Secretary of State may prescribe some other required number of
16applications if that number is sufficient to pay for the total

1cost of designing, manufacturing and issuing the special
2license plate.
3    (b) The Secretary of State, upon issuing a new series of
4special license plates, shall notify all law enforcement
5officials of the design, color and other special features of
6the special license plate series.
7    (c) This Section shall not apply to special license plate
8categories in existence on the effective date of this
9amendatory Act of 1990, or to the Secretary of State's
10discretion as established in Section 3-611.
11    (d) Beginning with the 2013 registration year, the
12provisions of Section 3-600.1 control the issuance and
13re-issuance of special plates.

16    Sec. 3-600.1. Special plates; issuance and reissuance.
17    (a) Beginning with the 2013 registration year, the
18Secretary of State may reissue only those special plates that
19exist as of the effective date of this amendatory Act of the
2097th General Assembly. The Secretary shall continue to accept
21annual fees for renewal stickers for those plates from those
22persons.
23    (b) Beginning with the 2013 registration year, the
24Secretary may not issue any new category of special plates.
25    (c) Persons and organizations seeking issuance of special

1plates may apply for Universal Charitable Organization license
2plates under Section 3-633 of this Code, with charitable decals
3approved under that Section. The Secretary shall work in
4cooperation with persons and organization seeking issuance of
5Universal Charitable Organization plates in the design of
6appropriate decals. There shall be no limit to the number of
7Universal Charitable Organization plates which may be issued
8under Section 3-633 of this Code.

10    Sec. 3-633. Universal Charitable Organization license
11plate.
12    (a) In addition to any other special license plate, the
13Secretary, upon receipt of all applicable fees and applications
14made in the form prescribed by the Secretary of State, may
15issue Universal Charitable Organization license plates to
16residents of Illinois on behalf of organizations that meet the
17requirements of Title 26, Section 501(c)(3) of the United
18States Code formed for any bona fide charitable, benevolent,
19philanthropic, or patriotic purpose. The Secretary of State may
20prescribe rules establishing additional eligibility criteria
21for charitable organizations under this Section. The special
22Universal Charitable Organization plate issued under this
23Section shall be affixed only to passenger vehicles of the
24first division and motor vehicles of the second division
25weighing not more than 8,000 pounds. Plates issued under this

1Section shall expire according to the staggered multi-year
2procedure established by Section 3-414.1 of this Code.
3    (b) The design, color, and format of the plates shall be
4wholly within the discretion of the Secretary of State. The
5plates are not required to designate "Land of Lincoln", as
6prescribed in subsection (b) of Section 3-412 of this Code.
7Charitable organizations deemed eligible by the Secretary of
8State shall design charitable decals to be affixed on the right
9side of plates issued under this Section. The Secretary may
10prescribe rules governing the requirements and approval of
11charitable decals.
12    (b-5) The Secretary shall not issue a series of decals
13unless applications, as prescribed by the Secretary, have been
14received for 1,500 decals of that series. Each series of
15charitable decals issued under this Section shall be assigned
16an individual number by the Secretary.
17    (c) An applicant shall be charged a $15 fee for original
18issuance in addition to the applicable registration fee. This
19additional fee shall be deposited into the Secretary of State
20Special License Plate Fund. For each registration renewal
21period, a $2 fee, in addition to the appropriate registration
22fee, shall be charged and shall be deposited into the Secretary
23of State Special License Plate Fund. Charitable organizations
24may establish a fee for the purchase of their charitable decal.
25The Secretary shall collect the fee established by each
26charitable organization for its charitable decal. and shall

1report by July 31 of each year to the Secretary of State
2Vehicle Services Department the sticker fee, the number of
3charitable decals sold, the total revenue received from the
4sale of charitable decals during the previous fiscal year, and
5any other information deemed necessary by the Secretary of
6State.
