AMENDMENT TO HOUSE BILL 230

AMENDMENT NO. ______. Amend House Bill 230 on page 1, line 12, by deleting "is"; and

on page 1, by replacing line 13 with the following:

"(1) has a nameplate generating capacity of less than 500 kilowatts;

(2) is interconnected at the distribution system level of"; and

on page 1, line 21, by replacing "(2)" with "(3) is"; and

on page 2, line 24, after "industrial,", by inserting "residential,"; and

on page 2, line 26, after "industrial,", by inserting "residential,"; and

on page 3, by replacing lines 2 through 3 with: "neighboring property line. A distributed wind energy generation device must comply with FAA requirements. Permits with respect to"; and

on page 3, line 7, by replacing "$100" with "$150. Counties that can reasonably demonstrate that a greater fee is necessary to cover the county's administrative costs related to issuing permits for distributed wind energy generation devices can require a fee that shall never be greater than a total of $350. The percentage increase in the fee cannot be more than the percentage increase in the consumer price index published by the Bureau of Labor Statistics in the 12-month calendar year immediately preceding the calendar year in which the fee is increased."; and

on page 3, line 16, after "devices", by inserting "for safety reasons".
