| AN ACT concerning utilities.
| 2 |
| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Public Utilities Act is amended by adding | 5 |
| Section 16-107.7 as follows: | 6 |
| (220 ILCS 5/16-107.7 new) | 7 |
| Sec. 16-107.7. Net Metering Task Force. | 8 |
| (a) The General Assembly finds and declares all of the | 9 |
| following: | 10 |
| (1) In Public Act 95-420, the General Assembly found | 11 |
| and declared that a program to provide net electricity | 12 |
| metering can (i) encourage private investment in renewable | 13 |
| energy resources, (ii) stimulate economic growth, (iii) | 14 |
| enhance the continued diversification in Illinois' energy | 15 |
| resource mix, and (iv) protect the Illinois environment. | 16 |
| (2) The Illinois net metering program provides retail | 17 |
| rate net metering for systems with a nameplate rating of 40 | 18 |
| kilowatts and below. | 19 |
| (3) The General Assembly finds that it is in the | 20 |
| public's best interest to establish a task force to study | 21 |
| and evaluate net metering program experiences in other | 22 |
| states, examine the status of net metering in Illinois, and | 23 |
| determine whether any changes to the statutes concerning |

| Illinois net metering are necessary. | 2 |
| (b) The General Assembly establishes the Net Metering Task | 3 |
| Force comprised of 16 members to be appointed no later than | 4 |
| August 2, 2010 in the following manner: | 5 |
| (1) one member appointed by the President of the | 6 |
| Senate; | 7 |
| (2) one member appointed by the Minority Leader of the | 8 |
| Senate; | 9 |
| (3) one member appointed by the Speaker of the House of | 10 |
| Representatives; | 11 |
| (4) one member appointed by the Minority Leader of the | 12 |
| House of Representatives; | 13 |
| (5) one member appointed by the Attorney General; and | 14 |
| (6) 11 members appointed by the Governor, including one | 15 |
| representative from the Office of the Governor, one | 16 |
| representative from the Illinois Commerce Commission, one | 17 |
| representative of the Illinois Power Agency, one | 18 |
| representative from the Department of Commerce and | 19 |
| Economic Opportunity, one representative from the Citizens | 20 |
| Utility Board, one representative from a membership | 21 |
| organization representing alternative retail electric | 22 |
| suppliers, one representative from the environmental | 23 |
| community, one representative from an Illinois public | 24 |
| utility serving 2 million or more retail electric | 25 |
| customers, one representative from 3 legally affiliated | 26 |
| Illinois public utilities serving fewer than 2 million |

| retail electric customers, one representative from a | 2 |
| membership organization representing Illinois public | 3 |
| utilities, and one representative from a membership | 4 |
| organization representing Illinois retail merchants. | 5 |
| The Governor shall name a chairperson from among the Task | 6 |
| Force appointees. | 7 |
| (c) No later than March 1, 2011, the Task Force shall | 8 |
| submit a report to the General Assembly concerning the status | 9 |
| of net metering in Illinois and whether any legislative and | 10 |
| programmatic changes to the existing net metering law are | 11 |
| necessary. The Chairperson of the Task Force shall submit a | 12 |
| draft report to each of the members of the Task Force at least | 13 |
| 30 days before submitting the required report to the General | 14 |
| Assembly. The members of the Task Force shall discuss the draft | 15 |
| report and record any votes taken on its contents. The draft | 16 |
| report receiving the approval of a majority of those appointed | 17 |
| to the Task Force shall be submitted to the General Assembly. | 18 |
| Any Task Force member voting not to approve the Task Force | 19 |
| report shall be allowed to submit a minority report for | 20 |
| inclusion in the Task Force report. The Task Force report to | 21 |
| the General Assembly shall include all minority reports | 22 |
| submitted to the Chairperson within 10 business days after the | 23 |
| day the Task Force approves the required report. | 24 |
| (d) The Task Force report shall include, at a minimum, | 25 |
| discussion of the following topics: | 26 |
| (1) net metering policies and experiences from other |

| states; | 2 |
| (2) the effects associated with expanded net metering | 3 |
| development in Illinois, including its impact on renewable | 4 |
| and diversified energy development, economic development, | 5 |
| job growth, peak electricity consumption, grid operation | 6 |
| and maintenance, and the environment; | 7 |
| (3) any uneconomic existing barriers to net metering | 8 |
| development in Illinois; | 9 |
| (4) whether legislation, policies, and other best | 10 |
| practices should be implemented to address uneconomic | 11 |
| barriers to net metering development in Illinois; | 12 |
| (5) the overall consumer costs and rate impacts, if | 13 |
| any, associated with implementing these policies, | 14 |
| including taking into account the associated benefits of | 15 |
| net metering development in Illinois; and | 16 |
| (6) an evaluation of the current net metering law to | 17 |
| determine how well it is functioning among the | 18 |
| participating utilities. | 19 |
| (e) The Illinois Commerce Commission shall provide | 20 |
| administrative support for the Task Force.

| Section 99. Effective date. This Act takes effect upon | 22 |
| becoming law.
