SYNOPSIS AS INTRODUCED:
 
20 ILCS 1305/10-31 new

    Amends the Department of Human Services Act. Provides that subject to appropriation, there is created the HIV/AIDS Nutrition and Outcomes Advisory Commission to advise the Department of Human Services on how best to incorporate nutrition as an HIV/AIDS disease management strategy into State health policy to avoid Medicaid hospitalizations, and how to measure health care outcomes that will likely be required by new federal legislation. Provides that the Commission shall consist of 9 members including 5 members appointed by the Governor. Contains provisions on terms of membership; Commission meetings; and reporting requirements. Effective immediately.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Human Services Act is amended
5 by adding Section 10-31 as follows:
 
6     (20 ILCS 1305/10-31 new)
7     Sec. 10-31. HIV/AIDS Nutrition and Outcomes Advisory
8 Commission.
9     (a) Subject to appropriation, the HIV/AIDS Nutrition and
10 Outcomes Advisory Commission is created to advise the
11 Department on how best to incorporate nutrition as an HIV/AIDS
12 disease management strategy into State health policy to avoid
13 Medicaid hospitalizations, and how to measure health care
14 outcomes that will likely be required by new federal
15 legislation.
16     (b) The Commission shall consist of all of the following
17 members:
18         (1) One member of the Senate appointed by the President
19     of the Senate and one member of the Senate appointed by the
20     Minority Leader of the Senate.
21         (2) One member of the House of Representatives
22     appointed by the Speaker of the House of Representatives
23     and one member of the House of Representatives appointed by

1     the Minority Leader of the House of Representatives.
2         (3) Five members appointed by the Governor as follows:
3             (A) One representative of a not-for-profit social
4         service agency that provides clinical nutrition
5         services to individuals with HIV/AIDS.
6             (B) One representative of a teaching medical
7         hospital that collaborates with community social
8         service providers.
9             (C) One representative of a social service agency
10         that provides outreach, counseling, and housing for
11         HIV/AIDS infected individuals.
12             (D) One person who is a licensed physician with
13         expertise in treating individuals with HIV/AIDS.
14             (E) One representative of a not-for-profit
15         community based agency that provides direct care,
16         supportive services, and education related to
17         HIV/AIDS.
18     Each Commission member shall serve for a term of 3 years
19 and until his or her successor is appointed. Vacancies shall be
20 filled in the same manner as original appointments.
21     (c) The Commission shall meet to organize and select a
22 chairperson upon appointment of a majority of the members. The
23 chairperson shall be elected by a majority vote of the members
24 appointed to the Commission. The Commission shall meet at least
25 4 times a year at the call of the chairperson. Members of the
26 Commission shall serve without compensation, but may be

1 reimbursed for reasonable expenses incurred as a result of
2 their duties as members of the Commission from funds
3 appropriated to the Department for that purpose.
4     (d) The Commission shall submit an annual report to the
5 Department on or before July 1, 2011 and on or before July 1 of
6 each year thereafter with its recommendations.
 
7     Section 99. Effective date. This Act takes effect upon
8 becoming law.
