1     AN ACT concerning finance.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Downstate Public Transportation Act is
5 amended by changing Section 2-5.1 as follows:
 
6     (30 ILCS 740/2-5.1)
7     Sec. 2-5.1. Additional requirements.
8     (a) Any unit of local government that becomes a participant
9 on or after the effective date of this amendatory Act of the
10 94th General Assembly shall, in addition to any other
11 requirements under this Article, meet all of the following
12 requirements when applying for grants under this Article:
13         (1) The grant application must demonstrate the
14     participant's plan to provide general public
15     transportation with an emphasis on elderly, disabled, and
16     economically disadvantaged populations.
17         (2) The grant application must demonstrate the
18     participant's plan for interagency coordination that, at a
19     minimum, allows the participation of all State-funded and
20     federally-funded agencies and programs with transportation
21     needs in the proposed service area in the development of
22     the applicant's public transportation program.
23         (3) Any participant serving a nonurbanized area that is

1     not receiving Federal Section 5311 funding must meet the
2     operating and safety compliance requirements as set forth
3     in that federal program.
4         (4) The participant is required to hold public hearings
5     to allow comment on the proposed service plan in all
6     municipalities with populations of 1,500 inhabitants or
7     more within the proposed service area.
8     (b) Service extensions by any participant after July 1,
9 2005 by either annexation or intergovernmental agreement must
10 meet the 4 requirements of subsection (a).
11     (c) In order to receive funding, the Department shall
12 certify that the participant has met the requirements of this
13 Section. Funding priority shall be given to service extension,
14 multi-county, and multi-jurisdictional projects.
15     (d) The Department shall develop an application process for
16 funding in new service areas. The application shall seek
17 information from potential applicants that includes, but is not
18 limited to, a description of the proposed service in the new
19 area and a budget for providing that service. The application
20 must also contain the information described in item (1) of
21 subsection (a) of this Section. The Department shall certify
22 that the applicant has met the requirements of this Section and
23 shall submit an appropriation for the applicant that is equal
24 to 65% of eligible operating expenses of an approved budget for
25 the applicant's new service area. If the applicant is an
26 existing participant that is extending its service area, either

1 by annexation or intergovernmental agreement, then, in the
2 first fiscal year following the extension of the service area,
3 that participant's appropriation shall exceed its 10% annual
4 growth by an amount equal to 65% of eligible operating expenses
5 of its approved budget for the new service area.
