1 AMENDMENT TO HOUSE BILL 1606
2     AMENDMENT NO. ______. Amend House Bill 1606 by replacing
3 everything after the enacting clause with the following:

4     "Section 5. The Counties Code is amended by adding Section
5 5-1063.5 as follows:

6     (55 ILCS 5/5-1063.5 new)
7     Sec. 5-1063.5. Permits for demolition and renovation;
8 asbestos. Before a county may issue a demolition or renovation
9 permit for property that is regulated under Part 61 of Title 40
10 of the Code of Federal Regulations (NESHAP), the county must
11 notify the permit applicant of the requirement to file a NESHAP
12 notification form with the Illinois Environmental Protection
13 Agency, as required by Section 61.145(b) of Title 40 of the
14 Code of Federal Regulations. A county may seek assistance from
15 the Illinois Environmental Protection Agency or any other State
16 agency in developing procedures to implement the provisions of

1 this Section.

2     Section 10. The Illinois Municipal Code is amended by
3 adding Section 11-39-2.5 as follows:

4     (65 ILCS 5/11-39-2.5 new)
5     Sec. 11-39-2.5. Permits for demolition and renovation;
6 asbestos. Before a municipality may issue a demolition or
7 renovation permit for property that is regulated under Part 61
8 of Title 40 of the Code of Federal Regulations (NESHAP), the
9 municipality must notify the permit applicant of the
10 requirement to file a NESHAP notification form with the
11 Illinois Environmental Protection Agency, as required by
12 Section 61.145(b) of Title 40 of the Code of Federal
13 Regulations. A municipality may seek assistance from the
14 Illinois Environmental Protection Agency or any other State
15 agency in developing procedures to implement the provisions of
16 this Section.

17     Section 90. The State Mandates Act is amended by adding
18 Section 8.35 as follows:

19     (30 ILCS 805/8.35 new)
20     Sec. 8.35. Exempt mandate. Notwithstanding Sections 6 and 8
21 of this Act, no reimbursement by the State is required for the
22 implementation of any mandate created by this amendatory Act of

1 the 96th General Assembly.

2     Section 99. Effective date. This Act takes effect 90 days
3 after becoming law.".
