AMENDMENT TO HOUSE BILL 4164

AMENDMENT NO. ______. Amend House Bill 4164 on page 4, by replacing lines 4 through 15 with the following:

"(f) If a special use permit is issued after the effective date of this amendatory Act of the 95th General Assembly, then that permit expires 5 years after the date on which the permit is issued unless the project for which the permit is issued starts and proceeds with due diligence. The county may, by ordinance or resolution, provide for an expiration period that is less than 5 years. The county may extend that permit for an additional period of up to 5 years."; and

on page 5, by replacing lines 23 through 26 with the following:

"(b) If a special use permit is issued after the effective date of this amendatory Act of the 95th General Assembly, then that permit expires 5 years after the date on which the permit is issued unless the project for which the permit is issued starts and proceeds with due diligence. The municipality may, by ordinance or resolution, provide for an expiration period that is less than 5 years. The municipality may extend that permit for an additional period of up to 5 years."; and

on page 6, by deleting lines 1 through 8.
