| AN ACT concerning transportation.

| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Illinois Vehicle Code is amended by changing | 5 |
| Sections 3-609, 3-620, 3-621, 3-622, 3-623, 3-624, 3-625, | 6 |
| 3-806.1, 3-806.4, and 3-806.5 as follows:

| (625 ILCS 5/3-609) (from Ch. 95 1/2, par. 3-609)
| 8 |
| Sec. 3-609. Disabled Veterans' Plates. Any disabled | 9 |
| veteran who has
been or declared eligible for funds for the | 10 |
| purchase of a motor
vehicle of the first division or for a | 11 |
| motor vehicle of the second division
weighing not more than | 12 |
| 8,000 pounds by the United States Federal Government
because of | 13 |
| his disability, may make application for the registration of | 14 |
| one
such vehicle, to the Secretary of State without the payment | 15 |
| of any
registration fee. The Secretary may, in his or her | 16 |
| discretion, allow the plates to be issued as vanity or | 17 |
| personalized plates in accordance with Section 3-405.1 of this | 18 |
| Code. Registration shall be for a multi-year period effective
| 19 |
| in 1980 and may be issued staggered registration.
| 20 |
| Any disabled veteran of World War I, of World War II, of | 21 |
| the National
Emergency between June 25, 1950 and January 31, | 22 |
| 1955 or of the period
beginning February 1, 1955 and ending on | 23 |
| the day before the first day
thereafter in which individuals |

| (other than individuals liable for
induction by reason of prior | 2 |
| deferment) are no longer liable for
induction for training and | 3 |
| service into the armed forces under the
Military Selective | 4 |
| Service Act of 1967, or of any armed conflict
involving the | 5 |
| armed forces of the United States, who has a
service-connected | 6 |
| disability of such a nature that it would, if it had
been | 7 |
| incurred in World War II, have entitled him to be awarded an
| 8 |
| automobile by the United States Federal Government, or who is | 9 |
| receiving
compensation from the Veterans Administration for | 10 |
| total service-connected
disability, may make application to | 11 |
| the Secretary of State for the
registration of one motor | 12 |
| vehicle of the first division without
accompanying such | 13 |
| application with the payment of any fee.
| 14 |
| Renewal of such registration must be accompanied with | 15 |
| documentation
for eligibility of registration without fee | 16 |
| unless the applicant has a
permanent qualifying disability, and | 17 |
| such registration plates may not be
issued to any person not | 18 |
| eligible therefor.

| The Illinois Veterans Commission may assist in providing | 20 |
| the
documentation of disability.

| Sec. 3-620. The Secretary, upon receipt of an application | 24 |

form prescribed by the Secretary of State, may | 25 |
| issue special registration
plates to United States citizens, |

| who are present or former
members of the United States armed | 2 |
| forces or any of its allies, and
who were prisoners of war of | 3 |
| World War I, World War II, the
Korean Conflict, and the | 4 |
| Vietnamese conflict,
or to the widowed spouse of a former | 5 |
| member of the United States armed
forces, providing that | 6 |
| widowed spouse was married to the POW at the time
of death, and | 7 |
| is a single person at the time of application. The special
| 8 |
| plates issued pursuant to this Section shall be affixed only to | 9 |
| passenger
vehicles of the first division subject to the
| 10 |
| staggered registration
system, motorcycles, and vehicles of | 11 |
| the second division having a gross
weight of 8,000
pounds or | 12 |
| less and shall be issued
without charge. Only one set of plates | 13 |
| may be issued at no fee.
| 14 |
| The design and color of the prisoner of war plates shall be | 15 |
| wholly within
the discretion of the Secretary of State. The | 16 |
| Secretary may, in his or her discretion, allow the plates to be | 17 |
| issued as vanity or personalized plates in accordance with | 18 |
| Section 3-405.1 of this Code.

| or motor vehicles of the second division
weighing not

| 8,000 pounds subject to the staggered registration system.

| The design and color of such plates shall be wholly within | 7 |
| the discretion of
the Secretary of State. The Secretary may, in | 8 |
| his or her discretion, allow the plates to be issued as vanity | 9 |

| members who resided in Illinois, special
registration plates. | 21 |
| The special plates issued pursuant to this Section
shall be | 22 |
| affixed only to passenger vehicles of the first division, | 23 |
| motorcycles,
or
motor vehicles of the second division weighing | 24 |
| not more than 8,000 pounds
subject
to the staggered | 25 |

| Sec. 3-623. Purple Heart Plates. The Secretary, upon | 9 |
| receipt of an
application made in the form prescribed by the | 10 |
| Secretary of State, may
issue to recipients awarded the Purple | 11 |
| Heart by a branch of the armed
forces of the United States who | 12 |
| reside in Illinois,
special
registration plates. The | 13 |
| Secretary, upon receipt of the proper application | 14 |
| applications , may also issue these special registration plates | 15 |
| to an Illinois resident who is the surviving spouse of a person | 16 |
| who was killed in a foreign war and was awarded the Purple | 17 |
| Heart by a branch of the armed forces of the United States. The | 18 |
| special plates issued pursuant to this Section
should be | 19 |
| affixed only to passenger vehicles of the 1st division, | 20 |
| including
motorcycles, or motor
vehicles of the 2nd division | 21 |
| weighing not more than 8,000 pounds. The Secretary may, in his | 22 |
| or her discretion, allow the plates to be issued as vanity or | 23 |
| personalized plates in accordance with Section 3-405.1 of this | 24 |
| Code.

| The design and color of such plates shall be wholly within |

of the Secretary of State. Appropriate | 2 |
| documentation, as determined by the
Secretary, and the | 3 |
| appropriate registration fee shall
accompany the application.

| However, for an individual who has been issued Purple Heart | 5 |
| plates for a
vehicle and who has been approved for benefits | 6 |
| under the Senior Citizens and
Disabled Persons Property Tax | 7 |
| Relief and Pharmaceutical Assistance Act, the annual fee for
| 8 |
| the registration of the vehicle shall be as provided in Section | 9 |
| 3-806.3 of
this Code.

| vehicles of the second division weighing not more than 8,000 | 20 |
| pounds
and subject to the staggered registration system. The | 21 |
| design and color of
such plates shall be wholly within the | 22 |
| discretion of the Secretary of State. The Secretary may, in his | 23 |
| or her discretion, allow the plates to be issued as vanity or | 24 |
| personalized plates in accordance with Section 3-405.1 of this | 25 |
| Code.

| Sec. 3-625. Pearl Harbor Plates. The Secretary, upon | 4 |
| receipt of an
application made in the form prescribed by the | 5 |
| Secretary of State, may
issue special registration plates to | 6 |
| any Illinois resident who, while a
member of the armed forces | 7 |
| of the United States, participated in the battle
of Pearl | 8 |
| Harbor on December 7, 1941, or to the widowed spouse of any | 9 |
| Illinois
resident who, while a member of the armed forces of | 10 |
| the United States,
participated in the battle of Pearl Harbor | 11 |
| on December 7, 1941, provided that
the widowed spouse was | 12 |
| married to the battle of Pearl Harbor participant at the
time | 13 |
| of the participant's death and is a single person at the time | 14 |
| of
application. The special plates issued pursuant to
this | 15 |
| Section should be affixed only to passenger vehicles of the 1st
| 16 |
| division, motorcycles, or motor vehicles of the 2nd division | 17 |
| weighing not more
than
8,000 pounds. The Secretary may, in his | 18 |
| or her discretion, allow the plates to be issued as vanity or | 19 |
| personalized plates in accordance with Section 3-405.1 of this | 20 |
| Code.

| The design and color of such plates shall be wholly within | 22 |
| the
discretion of the Secretary of State. Appropriate | 23 |
| documentation, as
determined by the Secretary, and the | 24 |
| appropriate registration
fee shall accompany the application.

| Sec. 3-806.1. Additional fees for vanity license plates. In | 4 |
| addition to
the regular registration fee, an applicant for a | 5 |
| vanity license plate, other than a vanity plate in any military | 6 |
| series or a vanity plate issued under Section 3-806.4, shall be | 7 |
| charged $94
for each set of vanity license plates issued to a | 8 |
| motor vehicle of the first
division or a motor vehicle of the | 9 |
| second division registered at not more than
8,000 pounds or to | 10 |
| a recreational vehicle and $50 for each set of
vanity plates | 11 |
| issued to a motorcycle. In addition to the regular renewal fee,
| 12 |
| an applicant for a vanity plate, other than a vanity plate in | 13 |
| any military series or a vanity plate issued under Section | 14 |
| 3-806.4, shall be charged $13 for the renewal of each set of
| 15 |
| vanity license plates. There shall be no additional fees for a | 16 |
| vanity license plate in any military series of plates or a | 17 |
| vanity plate issued under Section 3-806.4.

| Sec. 3-806.4. Gold Star recipients. Commencing with the | 21 |
| 1991
registration year and through the 2006 registration year, | 22 |
| upon proper application, the Secretary of State shall
issue one | 23 |
| pair of registration plates to any Illinois resident, who as | 24 |
| the
surviving widow or widower, or in the absence thereof, as |

| the surviving
parent, is awarded the Gold Star by the United | 2 |
| States in recognition of
spouses or children who served in the | 3 |
| Armed Forces of the United States and
lost their lives while in | 4 |
| service whether in peacetime or war. Commencing with the 2007 | 5 |
| registration year, upon proper application, the Secretary of | 6 |
| State shall
issue one pair of registration plates to any | 7 |
| Illinois resident, who as the
surviving widow, widower,
or | 8 |
| parent, is awarded the Gold Star by the United States in | 9 |
| recognition of
spouses or children who served in the Armed | 10 |
| Forces of the United States and
lost their lives while in | 11 |
| service whether in peacetime or war. If the parent
no longer | 12 |
| survives, the Secretary of State shall issue the plates to a
| 13 |
| surviving sibling, of the person who served in the Armed | 14 |
| Forces, who is an
Illinois resident. No more than
one set of | 15 |
| plates shall be issued for each Gold Star awarded, and only one
| 16 |
| surviving parent, or in the absence of a surviving parent, only | 17 |
| one surviving
sibling shall be issued a set of registration | 18 |
| plates, except for
those surviving parents who, as recipients | 19 |
| of the Gold Star, have legally
separated or divorced, in which | 20 |
| case each surviving parent shall be allowed
one set of | 21 |
| registration plates. Registration plates issued under this
| 22 |
| Section shall be for first division vehicles and second | 23 |
| division vehicles
of 8,000 pounds or less. The Secretary may, | 24 |
| in his or her discretion, allow the plates to be issued as | 25 |
| vanity or personalized plates in accordance with Section | 26 |
| 3-405.1 of this Code. Through the 2006 registration year, an |

| applicant shall be charged a $15 fee for the
original issuance | 2 |
| in addition to the appropriate registration fee which
shall be | 3 |
| deposited into the Road Fund to help defray the administrative
| 4 |
| processing costs. Beginning with the 2007 registration year, an | 5 |
| applicant shall be charged only the appropriate registration | 6 |
| fee.

| Sec. 3-806.5. Additional fees for personalized license | 11 |
| plates. For
registration periods commencing after December 31, | 12 |
| 2003, in addition to the
regular registration fee, an applicant | 13 |
| for a personalized license plate, other than a personalized | 14 |
| plate in any military series or a personalized plate issued | 15 |
| under Section 3-806.4, shall be charged $47 for each set of
| 16 |
| personalized license plates issued to a motor vehicle of the | 17 |
| first division or
a motor vehicle of the second division | 18 |
| registered at not more than 8,000 pounds
or to a recreational | 19 |
| vehicle and $25 for each set of personalized plates issued
to a | 20 |
| motorcycle. In addition to the regular renewal fee, an | 21 |
| applicant for a personalized plate other than a personalized | 22 |
| plate in any military series or a personalized plate issued | 23 |
| under Section 3-806.4, shall be
charged $7 for the renewal of | 24 |

money received by the Secretary of | 3 |
| State as additional fees for personalized
license plates, 50% | 4 |
| shall be deposited into the Secretary of State Special

| Plate Fund and 50% shall be deposited into the General Revenue | 6 |
| Fund.
