AMENDMENT TO SENATE BILL 2415

2     AMENDMENT NO. ______. Amend Senate Bill 2415 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Illinois Public Aid Code is amended by
5 adding Section 5-5e as follows:
 
6     (305 ILCS 5/5-5e new)
7     Sec. 5-5e. Waiver for home and community-based services for
8 children with autism spectrum disorder and other developmental
9 disabilities. No later than September 1, 2006, the Department
10 of Healthcare and Family Services shall submit an application
11 for a waiver from the United States Centers for Medicare and
12 Medicaid Services pursuant to Section 1915(c) of the Social
13 Security Act to allow payment for in-home and community-based
14 treatment, therapies, training including parent training, and
15 other necessary aids and services for children from the age of
16 3 to the age of 21 who are diagnosed with autism spectrum
17 disorder or another developmental disability, including those
18 children whose families would not otherwise qualify for medical
19 assistance under this Article due to family income or assets.
20 The application must request an implementation date of January
21 1, 2007, or as soon thereafter as may be approved by the United
22 States Centers for Medicare and Medicaid Services. The
23 application shall provide for significant participation in the
24 waiver by children diagnosed with autism spectrum disorder, and

1 the Department shall set the following targets for such
2 participation: (i) a minimum of 800 children in the first year
3 of the waiver, of which at least 500 shall be children with
4 autism spectrum disorder; (ii) a minimum of 1,750 children in
5 the second year of the waiver, of which at least 1,000 shall be
6 children with autism spectrum disorder; and (iii) a minimum of
7 3,350 children in the third year of the waiver, of which at
8 least 2,000 shall be children with autism spectrum disorder.
 
9     Section 99. Effective date. This Act takes effect upon
10 becoming law.".
