1     AN ACT concerning government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Counties Code is amended by changing
5 Sections 2-3009, 2-5007, 3-5004, and 3-6002 as follows:
 
6     (55 ILCS 5/2-3009)  (from Ch. 34, par. 2-3009)
7     Sec. 2-3009. Terms of board members; vacancies; elections.
8     (a) County board member elections by county board
9 districts. In those counties subject to this Division which
10 elect county board members by county board districts the
11 members shall, no later than 45 days after December 15, 1982,
12 and thereafter no later than September 1 of the year of the
13 next general election following reapportionment, divide the
14 county board districts publicly by lot as equally as possible
15 into 2 groups. Board members or their successors from one group
16 shall be elected for successive terms of 2 years, 4 years and 4
17 years; and members or their successors from the second group
18 shall be elected for successive terms of 4 years, 4 years, and
19 2 years. A county under this subsection may, by ordinance,
20 decide to divide the county board districts into 3 rather than
21 2 groups. If a county adopts an ordinance to this effect, the
22 members of the county board shall divide the county board
23 districts publicly by lot as equally as possible into 3 groups
24 no later than September 1 of the year of the next general
25 election following reapportionment. Board members or their
26 successors from one group shall be elected for successive terms
27 of 2 years, 4 years, and 4 years; members or their successors
28 from the second group shall be elected for successive terms of
29 4 years, 2 years, and 4 years; and members or their successors
30 from the third group shall be elected for successive terms of 4
31 years, 4 years, and 2 years. All terms shall commence on the
32 third first Monday of the month following the month of

2     (b) County board member elections at large. In those
3 counties which elect county board members at large, under
4 Sections 2-3002 and 2-3006, the members elected in the general
5 election following reapportionment shall, no later than 45 days

8 successors from one group shall be elected for successive terms
9 of 2 years, 4 years and 4 years; and members or their
10 successors from the second group shall be elected for

12 under this subsection may, by ordinance, decide to divide the
13 county board members into 3 rather than 2 groups. If a county

26     (c) Vacancies; time for elections. In counties under
27 subsection (a) or (b), if a vacancy occurs in the office of
28 chairman of the county board, the remaining members of the
29 board shall elect one of the members of the board to serve for
30 the balance of the unexpired term of the chairman.
31     In counties under subsection (a) or (b), the time for the
32 election of county board members shall be as provided by the
33 general election law for the election of such members.

1     Sec. 2-5007. Term of county executive. The county executive
2 shall serve a term of 4 years, commencing on the third first
3 Monday in the month following the month of his election and
4 until his successor is elected and qualified.

7     Sec. 3-5004. Commencement of duties. The recorder shall
8 enter upon the duties of his office on the 15th first day in
9 the month of December following his election on which the
10 office of the recorder is required, by statute or by action of
11 the county board, to be open. He shall be commissioned by the
12 Governor.

15     Sec. 3-6002. Commencement of duties. The sheriff shall
16 enter upon the duties of his or her office on the 15th first
17 day in the month of December following his or her election on
18 which the office of the sheriff is required, by statute or by
19 action of the county board, to be open.

21     Section 10. The Illinois Highway Code is amended by
22 changing Section 6-116 as follows:
 
23     (605 ILCS 5/6-116)  (from Ch. 121, par. 6-116)
24     Sec. 6-116. Except as otherwise provided in this Section
25 with respect to highway commissioners of township and
26 consolidated township road districts, at the election provided
27 by the general election law in 1985 and every 4 years
28 thereafter in all counties, other than counties in which a
29 county unit road district has been established and other than
30 in Cook County, the highway commissioner of each road district
31 and the district clerk of each road district having an elected
32 clerk, shall be elected to hold office for a term of 4 years,

1 and until his successor is elected and qualified. The highway
2 commissioner of each road district and the district clerk of
3 each road district elected in 1979 shall hold office for an
4 additional 2 years and until his successor is elected and has
5 qualified.
6     In each township and consolidated township road district
7 outside Cook County, highway commissioners shall be elected at
8 the election provided for such commissioners by the general
9 election law in 1981 and every 4 years thereafter to hold
10 office for a term of 4 years and until his successor is elected
11 and qualified. The highway commissioner of each road district
12 in Cook County shall be elected at the election provided for
13 said commissioner by the general election law in 1981 and every
14 4 years thereafter for a term of 4 years, and until his
15 successor is elected and qualified.
16     Each highway commissioner shall enter upon the duties of
17 his office on the third first Monday in May after his election.
18     In road districts comprised of a single township, the
19 highway commissioner shall be elected at the election provided
20 for said commissioner by the general election law. All
21 elections as are provided in this Section shall be conducted in
22 accordance with the general election law.
