SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/12-610.1 new

    Amends the Illinois Vehicle Code. Provides that a person who holds an instruction permit may not use a wireless telephone while driving a vehicle. Provides that a violation is a petty offense punishable by a fine of not more than $79. Provides that the provision does not apply to the use of a wireless telephone for emergency purposes.

1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by adding
5 Section 12-610.1 as follows:
 
6     (625 ILCS 5/12-610.1 new)
7     Sec. 12-610.1. Wireless telephones.
8     (a) As used in this Section, "wireless telephone" means a
9 device that is capable of transmitting or receiving telephonic
10 communications without a wire connecting the device to the
11 telephone network.
12     (b) A person who holds an instruction permit issued under
13 Section 6-105 or 6-107.1 may not drive a vehicle while using a
14 wireless phone.
15     (c) This Section does not apply to a person using a
16 wireless telephone for emergency purposes, including, but not
17 limited to, an emergency call to a law enforcement agency,
18 health care provider, fire department, or other emergency
19 services agency or entity.
20     (d) A person who violates this Section is guilty of a petty
21 offense and subject to a fine of not more than $79.
