 1                    AMENDMENT TO SENATE BILL 1701

 2        AMENDMENT NO.     .  Amend Senate Bill 1701, AS  AMENDED,
 3    in   the  introductory  portion  of  Section  5,  before  "as
 4    follows", by  inserting  "and  adding  Sections  8-164.2  and
 5    11-160.2"; and

 6    in Section 5, after the end of Sec. 8-164.1, by inserting the
 7    following:

 8        "(40 ILCS 5/8-164.2 new)
 9        Sec.  8-164.2.   Payments to board of education for group
10    health benefits.
11        (a)  Should the Board of Education continue to sponsor  a
12    retiree  health  plan,  the board is authorized to pay to the
13    Board of Education, on behalf of each eligible annuitant  who
14    chooses  to  participate  in the Board of Education's retiree
15    health benefit plan, the following amounts:
16             (1)  From July 1, 2003 through June  30,  2008,  $85
17        per  month for each such annuitant who is not eligible to
18        receive Medicare benefits and $55 per month for each such
19        annuitant who is eligible to receive Medicare benefits.
20             (2)  From July 1, 2008 through June  30,  2013,  $95
21        per  month for each such annuitant who is not eligible to
22        receive Medicare benefits and $65 per month for each such

 1        annuitant who is eligible to receive Medicare benefits.
 2        The payments described in this subsection shall  be  paid
 3    from  the  tax  levy  authorized  under  Section  8-173; such
 4    amounts shall be credited to the reserve for  group  hospital
 5    care  and  group  medical and surgical plan benefits, and all
 6    payments to the Board  of  Education  under  this  subsection
 7    shall be charged against it.
 8        (b)  The  Board of Education health benefit plan referred
 9    to in this Section and the board's payments to the  Board  of
10    Education  under  this  Section  are  not  and  shall  not be
11    construed to  be  pension  or  retirement  benefits  for  the
12    purposes  of  Section  5  of  Article  XIII  of  the Illinois
13    Constitution of 1970."; and

14    in Section 5, after the end of Sec.  11-160.1,  by  inserting
15    the following:

16        "(40 ILCS 5/11-160.2 new)
17        Sec.  11-160.2.  Payments to board of education for group
18    health benefits.
19        (a)  Should the Board of Education continue to sponsor  a
20    retiree  health  plan,  the board is authorized to pay to the
21    Board of Education, on behalf of each eligible annuitant  who
22    chooses  to  participate  in the Board of Education's retiree
23    health benefit plan, the following amounts:
24             (1)  From July 1, 2003 through June  30,  2008,  $85
25        per  month for each such annuitant who is not eligible to
