 1                    AMENDMENT TO SENATE BILL 1701

 2        AMENDMENT NO.     .  Amend Senate Bill 1701, AS  AMENDED,
 3    in   the  introductory  portion  of  Section  5,  before  "as
 4    follows", by  inserting  "and  adding  Sections  8-164.2  and
 5    11-160.2"; and

 6    in Section 5, after the end of Sec. 8-164.1, by inserting the
 7    following:

 8        "(40 ILCS 5/8-164.2 new)
 9        Sec.  8-164.2.   Payments to board of education for group
10    health benefits.
11        (a)  The board is authorized  to  pay  to  the  Board  of
12    Education,  on  behalf of each eligible annuitant who chooses
13    to participate in the Board  of  Education's  retiree  health
14    benefit plan, the following amounts:
15             (1)  From  July  1,  2003 through June 30, 2008, $85
16        per month for each such annuitant who is not eligible  to
17        receive Medicare benefits and $55 per month for each such
18        annuitant who is eligible to receive Medicare benefits.
19             (2)  From  July  1,  2008 through June 30, 2013, $95
20        per month for each such annuitant who is not eligible  to
21        receive Medicare benefits and $65 per month for each such
22        annuitant who is eligible to receive Medicare benefits.

 1        The  payments  described in this subsection shall be paid
 2    from the  tax  levy  authorized  under  Section  8-173;  such
 3    amounts  shall  be credited to the reserve for group hospital
 4    care and group medical and surgical plan  benefits,  and  all
 5    payments  to  the  Board  of  Education under this subsection
 6    shall be charged against it.
 7        (b)  The Board of Education health benefit plan  referred
 8    to  in  this Section and the board's payments to the Board of
 9    Education under  this  Section  are  not  and  shall  not  be
10    construed  to  be  pension  or  retirement  benefits  for the
11    purposes of  Section  5  of  Article  XIII  of  the  Illinois
12    Constitution of 1970."; and

13    in  Section  5,  after the end of Sec. 11-160.1, by inserting
14    the following:

15        "(40 ILCS 5/11-160.2 new)
16        Sec. 11-160.2.  Payments to board of education for  group
17    health benefits.
18        (a)  The  board  is  authorized  to  pay  to the Board of
19    Education, on behalf of each eligible annuitant  who  chooses
20    to  participate  in  the  Board of Education's retiree health
21    benefit plan, the following amounts:
22             (1)  From July 1, 2003 through June  30,  2008,  $85
23        per  month for each such annuitant who is not eligible to
24        receive Medicare benefits and $55 per month for each such
25        annuitant who is eligible to receive Medicare benefits.
26             (2)  From July 1, 2008 through June  30,  2013,  $95
27        per  month for each such annuitant who is not eligible to
28        receive Medicare benefits and $65 per month for each such
29        annuitant who is eligible to receive Medicare benefits.
30        The payments described in this subsection shall  be  paid
31    from  the  tax  levy  authorized  under  Section 11-169; such
32    amounts shall be credited to the reserve for  group  hospital
33    care  and  group  medical and surgical plan benefits, and all
