 1        AN ACT in relation to public aid.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Illinois Public Aid Code  is  amended  by
 5    adding Section 12-13.3 as follows:

 6        (305 ILCS 5/12-13.3 new)
 7        Sec.  12-13.3.  Aid  for  victims of domestic violence or
 8    extreme cruelty.
 9        (a)  Subject to appropriations, the Department  of  Human
10    Services  shall  develop  and  implement a program to provide
11    cash assistance, equivalent to that provided to recipients of
12    aid under Article IV of this Code, to  persons  (i)  who  are
13    legal  immigrants  to  the  United  States, (ii) who would be
14    eligible for aid under Article IV but for the 5-year presence
15    requirement under Section 1-11, and (iii) who are either:
16             (1)  children who  have  been  victims  of  domestic
17        violence  or  extreme cruelty committed within the United
18        States; or
19             (2)  adults  who  have  been  victims  of   domestic
20        violence  or  extreme cruelty committed within the United
21        States, provided that such an adult has not committed the
22        domestic violence or  extreme  cruelty  against  a  child
23        described in paragraph (1).
24        The  Department shall provide aid under this Section as a
25    means of assisting the recipients to escape the circumstances
26    under which they have been subjected to domestic violence  or
27    extreme cruelty.
28        (b)  The  Department,  by rule, may impose a limit on the
29    period of time for which a person may receive aid under  this
30    Section,  which may not be less than one year. The Department
31    may also adopt rules imposing other reasonable limitations on

 1    recipients of aid under  this  Section  comparable  to  those
 2    placed on recipients of aid under Article IV.

 3        Section  99.  Effective  date.  This  Act takes effect on
 4    July 1, 2003.
