 1                    AMENDMENT TO HOUSE BILL 1843

 2        AMENDMENT NO.     .  Amend House Bill 1843  by  replacing
 3    everything after the enacting clause with the following:

 4        "Section  1.  Short  title.  This Act may be cited as the
 5    Umbilical Cord Blood Donation Act.

 6        Section 5.  Definitions. As used in this Act:
 7        "Cord blood" means blood  extracted  from  the  umbilical
 8    cord following the delivery of a newborn child.
 9        "Cord  blood  bank"  means an entity certified to collect
10    and store cord blood.

11        Section 10.  Donation; declaration.  All  physicians  and
12    nurses  shall,  at no expense to a pregnant patient, make the
13    patient aware of her  ability  to  donate  cord  blood  to  a
14    publicly accessible cord blood bank and shall obtain a signed
15    declaration  from  the patient indicating the decision of the
16    patient whether to accept or  decline  cord  blood  donation,
17    which   declaration  shall  be  maintained  as  part  of  the
18    patient's permanent medical record.

19        Section 15.  Exclusions.
20        (a)  Nothing in this Act obligates a physician  or  nurse

 1    to collect cord blood if, in the professional judgment of the
 2    physician  or nurse, the collection would threaten the health
 3    of the mother or child.
 4        (b)  Nothing in this Act imposes a requirement  upon  any
 5    physician,  nurse,  hospital,  or  medical  facility  that is
 6    directly affiliated with a bona fide  religious  denomination
 7    that  includes  as  an  integral  part  of  its  beliefs  and
 8    practices  the  tenet  that blood transfer is contrary to the
 9    moral  principles  the  denomination  considers  to   be   an
10    essential part of its beliefs.".
