AMENDMENT TO HOUSE BILL 853

AMENDMENT NO. ______. Amend House Bill 853, AS AMENDED, with reference to page and line numbers of Senate Amendment No. 1, on page 6, immediately below line 14, by inserting the following:

"Beginning on July 1, 2004, in case of a sale of dyed diesel fuel for consumption or use in the operation of ships, barges, or vessels used in or for commercial navigation or in or for the transportation of property on waters in this State, the distributor shall show in his or her return the amount of invoiced gallons of dyed diesel fuel sold and the name and address of the purchaser in addition to any other information the Department may require."; and

on page 7, line 33, by deleting "and"; and

on page 8, line 4, immediately after "Department", by inserting the following: "; and (10) beginning on July 1, 2004, if a sale of dyed diesel fuel is made for consumption or use in the operation of ships, barges, or vessels used in or for commercial navigation or in or for the transportation of property on waters in this State, by making a specific notation thereof on the invoice or sales slip covering that sale and obtaining any supporting documentation as may be required by the Department"; and

on page 12, immediately below line 19, by inserting the following:

"Beginning on July 1, 2004, in case of a sale of dyed diesel fuel for consumption or use in the operation of ships, barges, or vessels used in or for commercial navigation or in or for the transportation of property on waters in this State, the supplier shall show in his or her return the amount of invoiced gallons of dyed diesel fuel sold and the name and address of the purchaser in addition to any other information the Department may require."; and

on page 14, line 10, by deleting "and"; and

on page 14, line 16, immediately after "Department", by inserting the following:

"; and (9) beginning on July 1, 2004, if a sale of dyed diesel fuel is made for consumption or use in the operation of ships, barges, or vessels used in or for commercial navigation or in or for the transportation of property on waters in this State, by making a specific notation thereof on the invoice or sales slip covering that sale and obtaining any supporting documentation as may be required by the Department"; and

on page 16, line 1, by replacing "10" with "11"; and

on page 17, immediately below line 24, by inserting the following:

"11. Beginning on July 1, 2004, when a sale of dyed diesel fuel is made for consumption or use in the operation of ships, barges, or vessels used in or for commercial navigation or in or for the transportation of property on waters in this State, by making a specific notation thereof on the invoice or sales slip covering that sale and obtaining any supporting documentation as may be required by the Department. The distributor shall obtain and keep the supporting documentation in such form as the Department may require by rule."; and

on page 19, line 11, by replacing "9" with "10"; and

on page 20, immediately below line 30, by inserting the following:

"10. Beginning on July 1, 2004, when a sale of dyed diesel fuel is made for consumption or use in the operation of ships, barges, or vessels used in or for commercial navigation or in or for the transportation of property on waters in this State, by making a specific notation thereof on the invoice or sales slip covering that sale and obtaining any supporting documentation as may be required by the Department. The supplier shall obtain and keep the supporting documentation in such form as the Department may require by rule.".
