 1        AN ACT in relation to fire equipment.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  State  Fire  Marshal  Act is amended by
 5    adding Section 2.5 as follows:

 6        (20 ILCS 2905/2.5 new)
 7        Sec. 2.5.  Equipment exchange  program.  The  Office  may
 8    create   an  equipment  exchange  program  under  which  fire
 9    departments  and  fire  protection   districts   can   donate
10    equipment  to  the  State Fire Marshal.  The Marshal may then
11    re-issue any donated equipment that he certifies as  safe  to
12    other departments and districts.
13        A  fire  department  or  fire  protection  district  that
14    donates  fire  protection equipment to the State Fire Marshal
15    under this Section is not liable for  any  damage  or  injury
16    caused by the donated fire protection equipment provided that
17    the  donor discloses in writing to the State Fire Marshal any
18    known damage to or deficiencies in the equipment.

19        Section 99.  Effective date.  This Act takes effect  upon
20    becoming law.
