1    AN ACT concerning business.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Consumer Fraud and Deceptive Business
5Practices Act is amended by adding Section 2LLL as follows:
 
6    (815 ILCS 505/2LLL new)
7    Sec. 2LLL. Locksmith services.
8    (a) No person who engages in the business of a locksmith
9within the meaning of Section 5-10 of the Private Detective,
10Private Alarm, Private Security, Fingerprint Vendor, and
11Locksmith Act of 2004 shall commence work involving the keying,
12rekeying, installation, repair, opening, or modification of
13locks, for compensation that exceeds $100, without first
14providing to the consumer of such services primarily for
15personal, family, or household use:
16        (1) a written price estimate of the total cost of the
17    locksmith service, including the cost of labor, parts,
18    fees, estimates, service calls, diagnostics, disassembly,
19    reassembly, and all charges to complete the service, which
20    shall not be exceeded by more than 10% without the written
21    consent of the consumer; or
22        (2) a written price limit on the total cost of the
23    locksmith service which shall not be exceeded without the

1    written consent of the consumer.
2    If it is determined that, due to unforeseen circumstances,
3the written price estimate or limit is insufficient, the
4written consent of the consumer must be obtained before the
5service is performed.
6    (b) The person who performs the locksmith service shall
7disclose the locksmith license number and the legal name under
8which business is conducted on any written price estimate or
9price limit provided to a consumer, and if that person is
10employed by a locksmith agency the disclosure shall include the
11legal name, complete street address and locksmith license
12number of the locksmith agency and the legal name and locksmith
13license or registration number of the person who performs the
14service.
15    (c) The person who performs a locksmith service in
16accordance with this Section shall retain the original copy of
17the written price estimate or written price limit for a period
18of 2 years.
19    (d) A violation of this Section constitutes an unlawful
20practice within the meaning of this Act.
 
21    Section 99. Effective date. This Act takes effect upon
22becoming law.
