SYNOPSIS AS INTRODUCED:
 
815 ILCS 505/2LLL new

    Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that no person who engages in the business of a locksmith shall commence work involving the keying, rekeying, installation, repair, opening, or modification of locks, for compensation that exceeds $100, without first providing to the consumer a written price estimate or a written price limit. Provides for a number of disclosures on any written price estimate or limit. Provides that the person who performs a locksmith service shall retain the original copy of the written price estimate or limit for a period of 2 years. Provides that a violation is an unlawful practice under the Act. Effective immediately.

1    AN ACT concerning business.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Consumer Fraud and Deceptive Business
5Practices Act is amended by adding Section 2LLL as follows:
 
6    (815 ILCS 505/2LLL new)
7    Sec. 2LLL. Locksmith services.
8    (a) No person who engages in the business of a locksmith
9within the meaning of Section 5-10 of the Private Detective,
10Private Alarm, Private Security, Fingerprint Vendor, and
11Locksmith Act of 2004 shall commence work involving the keying,
12rekeying, installation, repair, opening, or modification of
13locks, for compensation that exceeds $100, without first
14providing to the consumer:
15        (1) a written price estimate of the total cost of the
16    locksmith service, including the cost of labor, parts,
17    fees, estimates, service calls, diagnostics, disassembly,
18    reassembly, and all charges to complete the service, which
19    shall not be exceeded by more than 10% without the written
20    consent of the consumer; or
21        (2) a written price limit on the total cost of the
22    locksmith service which shall not be exceeded without the
23    written consent of the consumer.

1    If it is determined that, due to unforeseen circumstances,
2the written price estimate or limit is insufficient, the
3written consent of the consumer must be obtained before the
4service is performed.
5    (b) The person who performs the locksmith service shall
6disclose the locksmith license number and the legal name under
7which business is conducted on any written price estimate or
8price limit provided to a consumer, and if that person is
9employed by a locksmith agency the disclosure shall include the
10legal name, complete street address and locksmith license
11number of the locksmith agency and the legal name and locksmith
12license or registration number of the person who performs the
13service.
14    (c) The person who performs a locksmith service in
15accordance with this Section shall retain the original copy of
16the written price estimate or written price limit for a period
17of 2 years.
18    (d) A violation of this Section constitutes an unlawful
19practice within the meaning of this Act.
 
20    Section 99. Effective date. This Act takes effect upon
21becoming law.
