SYNOPSIS AS INTRODUCED:
 
815 ILCS 505/2QQ new

    Amends the Consumer Fraud and Deceptive Business Practices Act. Authorizes the imposition of a civil penalty of $50,000 for a violation of this Act in connection with the provision of telecommunication services when the consumer is a person 60 years of age or older. Effective immediately.

1     AN ACT concerning consumer protection.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Consumer Fraud and Deceptive Business
5 Practices Act is amended by adding Section 2QQ as follows:
 
6     (815 ILCS 505/2QQ new)
7     Sec. 2QQ. Telecommunications service fraud; elderly
8 persons or disabled persons; additional penalties.
9     (a) For purposes of this Section:
10         (1) "Elderly person" means a person 60 years of age or
11     older.
12         (2) "Telecommunications service" has the meaning given
13     in Section 13-203 of the Public Utilities Act.
14     (b) With respect to the advertising, sale, provider
15 selection, plan selection, billings, or collections relating
16 to the provision of telecommunications service, when the
17 consumer is an elderly person, a civil penalty of $50,000 may
18 be imposed for each violation. The penalty imposed for a
19 violation of this Section shall be paid into the Community
20 Senior Services and Resources Fund.
 
21     Section 99. Effective date. This Act takes effect
22 immediately.
