Amends the Consumer Fraud and Deceptive Business Practices Act.
Authorizes the imposition of a civil
penalty of $50,000 for a violation of this Act in connection with the provision

telecommunication services when the consumer is a person 60 years of age or
older. Effective immediately.

| AN ACT concerning consumer protection.
|

| Be it enacted by the People of the State of Illinois, |
3 |
| represented in the General Assembly:
|

| Section 5. The Consumer Fraud and Deceptive Business |
5 |
| Practices Act is
amended by adding Section 2QQ as follows:
|

| (815 ILCS 505/2QQ new)
|
7 |
| Sec. 2QQ. Telecommunications service fraud; elderly |
8 |
| persons or disabled
persons;
additional penalties.
|

| (a) For purposes of this Section:
|
10 |
| (1) "Elderly person" means a person 60 years of age or |
11 |
| older.
|
12 |
| (2) "Telecommunications service" has the meaning given |
13 |
| in
Section 13-203 of the Public Utilities Act.
|
14 |
| (b) With respect to the advertising, sale, provider |
15 |
| selection, plan
selection, billings, or collections relating |
16 |
| to the provision of
telecommunications service,
when the |
17 |
| consumer is an elderly person, a civil penalty of
$50,000
may |
18 |
| be imposed for each violation. The penalty imposed for a |
19 |
| violation of this Section shall be paid into the Community |
20 |
| Senior Services and Resources Fund.

| Section 99. Effective date. This Act takes effect |
22 |
| immediately. |
