AN ACT concerning counties.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Counties Code is amended by adding Section 5-1049.3 as follows:

(55 ILCS 5/5-1049.3 new)

Sec. 5-1049.3. Transfer of vacant property. If the county owns a parcel of real property located in the county that (i) is vacant, (ii) is less than 2,000 square feet, (iii) has been exclusively maintained by an adjoining owner and his or her predecessors in title continuously for at least 30 years, (iv) has a fair market value of less than $1,000, and (v) has been incorrectly recorded or omitted from the county tax rolls, then, upon request of the adjoining owner and satisfactory proof of items (i) through (v), the county must quit claim its right, title, and interest in the property to the adjoining owner for $1 in consideration.

The county is not required to transfer the parcel, however, if the adjoining owner is in violation of any county ordinance or is delinquent in the payment of any property taxes upon the adjoining property.

This Section is judicially enforceable.

Section 90. The State Mandates Act is amended by adding Section 8.28 as follows:

(30 ILCS 805/8.28 new)

Sec. 8.28. Exempt mandate. Notwithstanding Sections 6 and 8 of this Act, no reimbursement by the State is required for the implementation of any mandate created by Section 5-1049.3 of the Counties Code.

Section 99. Effective date. This Act takes effect upon becoming law.
