SYNOPSIS AS INTRODUCED:
 
55 ILCS 5/5-1049.3 new
30 ILCS 805/8.28 new

    Amends the Counties Code. Provides that if a county owns a parcel of real property located in the county that (i) is vacant, (ii) is less than 2,000 square feet, (iii) has been exclusively maintained by an adjoining owner and his or her predecessors in title continuously for at least 30 years, and (iv) has a fair market value of less than $1,000, then, upon request of the adjoining owner and satisfactory proof of the status of the property, the county must quit claim its right, title, and interest in the property to the adjoining owner for $1 in consideration. Provides that this provision is judicially enforceable. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

1     AN ACT concerning counties.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Counties Code is amended by adding Section
5 5-1049.3 as follows:
 
6     (55 ILCS 5/5-1049.3 new)
7     Sec. 5-1049.3. Transfer of vacant property. If the county
8 owns a parcel of real property located in the county that (i)
9 is vacant, (ii) is less than 2,000 square feet, (iii) has been
10 exclusively maintained by an adjoining owner and his or her
11 predecessors in title continuously for at least 30 years, and
12 (iv) has a fair market value of less than $1,000, then, upon
13 request of the adjoining owner and satisfactory proof of items
14 (i) through (iv), the county must quit claim its right, title,
15 and interest in the property to the adjoining owner for $1 in
16 consideration.
17     This Section is judicially enforceable.

19     Section 90. The State Mandates Act is amended by adding
20 Section 8.28 as follows:
 
21     (30 ILCS 805/8.28 new)
22     Sec. 8.28. Exempt mandate. Notwithstanding Sections 6 and 8
23 of this Act, no reimbursement by the State is required for the
24 implementation of any mandate created by Section 5-1049.3 of
25 the Counties Code.
 
26     Section 99. Effective date. This Act takes effect upon
27 becoming law.
